Appendix C: Employment Law Update for 2016Appendix C: Employment Law Update for 2016Following is a brief review of new or updated employment laws, rulings and other developments thatneed to be addressed by California employers for 2016. These summaries do not provide all of the detailsnecessary to implement the laws and we strongly recommend you contact the appropriate agency (seelist below) or a labor attorney for the full description of the law and assistance in implementation.  Minimum Wage – The California minimum wage is $10.00 per hour, effective July 1, 2016. (Note: January 1, 2017 this increases to $11.00 per hour.) However, employers in a rapidly growing number of cities, including San Francisco, Los Angeles, Santa Monica, Oakland, San Diego, Richmond and others, must pay differing minimums that exceed the State’s. We recommend you check with your local governments to ensure your nonprofit is paying appropriately. Further, remember that the minimum rate to retain exempt status is two times the minimum rate. Check your exempt employees’ pay rates to ensure they are at least double the minimum in your particular location.  IRS 2016 Standard Mileage Rate is 54 cents per mile for business miles driven, down from 57.5 cents for 2015. Companies are not required to reimburse at this rate but can negotiate the rate with employees as long as it fully reimburses the employee. (Note: miles driven by individuals for charitable purposes are still deductible at 14¢ a mile.)  Exempt Classification Rates for Computer Software Professionals and Licensed Physicians – Effective 1/1/16, the minimum hourly rates for employees in these positions to be considered exempt are as follows: o Computer software employees: $41.85 per hour, up from $41.27 per hour o Licensed physicians: $76.24, up from $75.19 per hour  Paid Sick Leave – Effective 7/1/15 employees working in California for 30 or more days within a year after date of hire must accrue sick leave of at least one hour for every 30 hours worked. Employees are entitled to use accrued sick leave at any time after 90 days employment. Employers can limit the number of paid sick days to 24 hours in each year of employment. An amendment to this law now permits employees to use kin care leave for illness or preventive care for a child, parent, spouse, registered domestic partner, grandparent, grandchild or sibling.  The California Fair Pay Act strengthens other equal pay regulations in that it requires employers to pay the same rates as those paid to employees of the opposite sex for “substantially similar work” (skills, effort, and responsibilities) at any of its establishments. Further, the law prohibits retaliation against employees who help enforce this regulation. Employers must not prohibit employees from discussing the wages of others, disclosing their own pay, encouraging others to exercise their rights, or inquire about others’ pay.  Expanded E-verify law: It is now unlawful to use the E-verify system at a time or in a manner not required or authorized by law, to check the employment authorization of an existing employee or an applicant who has not received an offer of employment.  The Family School Partnership Act has been expanded to include allowing employees to take leave to find, enroll or reenroll their children in school or with a licensed child care provider. It also permits employees to take time off to address a childcare provider or school emergency.
