‫ﺍﻟﺴﻴﺪ ﻣﻘﺘﺪﻯ ﻣﺤﻤﺪ ﺍﻟﺼﺪﺭ )‪(٣٠١‬‬ ‫ﻟﻜﺜﻴﺮ ﻣﻦ ﺍﻟﻤﻜﻠﻔﻴﻦ‪ ،‬ﻫﻞ ﻳﻤﻜﻦ ﻭﺿﻊ ﻗﻴﻤﺔ ﺍﻟﻜﻔﺎﺭﺍﺕ‬ ‫ﻓﻲ ﺻﻨﺎﺩﻳﻖ ﺍﻟﻬﻴﺌﺔ ﺍﻻﺟﺘﻤﺎﻋﻴﺔ ﺃﻭ ﺍﻟﺘﻨﺴﻴﻖ ﻣﻊ ﺍﻟﻬﻴﺌﺔ‬ ‫ﺍﻻﺟﺘﻤﺎﻋﻴﺔ ﻟﺘﺒﻨﻲ ﺍﺳﺘﻼﻡ ﻭﺻﺮﻑ ﺍﻟﻜﻔﺎﺭﺍﺕ ﻋﻠﻰ‬ ‫ﺍﻟﻤﺴﻠﻤﻴﻦ؟‬ ‫‪ ‬‬ ‫‪ -١‬ﻳﺸﺘﺮﻁ ﻓﻲ ﻭﺟﻮﺏ ﺍﻟﻜﻔﺎﺭﺓ ﺃﻥ ﻳﻜﻮﻥ ﻋﺎﻟﻤﺎﹰ‬ ‫ﺑﻜﻮﻥ ﻣﺎ ﻳﺮﺗﻜﺒﻪ ﻣﻔﻄﺮﹰﺍ‪ ...‬ﻭﺣﺴﺐ ﻣﺎ ﻓﻬﻤﺘﻪ ﻣﻦ ﻫﺬﺍ‬ ‫ﺍﻟﺸﻖ ﺇﻧﻪ ﻋﺎﻟﻢ‪ .‬ﻭﻛﻔﺎﺭﺓ ﺍﻟﺠﻤﻊ‪ :‬ﺗﺨﻴﻴﺮﺍﹰ‪ :‬ﻋﺘﻖ ﺭﻗﺒﺔ ﺃﻭ‬ ‫ﺇﻃﻌﺎﻡ ﻋﺸﺮﺓ ﻣﺴﺎﻛﻴﻦ ﺃﻭ ﻛﺴﻮﺗﻬﻢ ﻓﺈﻥ ﻋﺠﺰ‪ :‬ﺻﺎﻡ‬ ‫ﺛﻼﺛﺔ ﺃﻳﺎﻡ ﻣﺘﻮﺍﻟﻴﺔ‪.‬‬ ‫‪ -٢‬ﻧﻌﻢ‪.‬‬ ‫‪ -٣‬ﻛﻼ ‪ ...‬ﺇﻃﻼﻗﺎﹰ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(٩٨‬ﻫﻞ ﻫﻨﺎﻙ ﻗﺎﻋﺪﺓ ﻋﺎﻣﺔ ﻳﻤﻜﻦ ﻣﻦ‬ ‫ﺧﻼﻟﻬﺎ ﺍﻟﺘﻤﻴﻴﺰ ﻋﻠﻰ ﺃﻥ ﺍﻟﻜﻔﺎﺭﺓ ﺛﺎﺑﺘﺔ ﻋﻠﻰ ﺍﻟﻤﻜﻠﻒ ﻓﻲ‬

‫ﻓﻲ ﺿﻴﺎﻓﺔ ﺍﷲ‬ ‫)‪(٣٠٢‬‬ ‫ﺗﺮﻙ ﺍﻟﺼﻮﻡ ﺃﻭ ﺍﻟﻘﻀﺎﺀ ﻓﻘﻂ ﻟﻌﺪﻡ ﻓﻬﻤﻨﺎ ﻟﻤﺎ ﻭﺭﺩ ﻓﻲ‬ ‫ﺍﻟﻤﻨﻬﺞ ﺍﻟﺸﺮﻳﻒ؟‬ ‫‪  ‬ﺍﻟﺘﻌﻤﺪ ﻭﺍﻟﻌﻠﻢ ﺑﺄﻥ ﺍﻟﻔﻌﻞ ﻣﻔﻄﺮ‬ ‫ﻓﺘﺠﺐ ﺍﻟﻜﻔﺎﺭﺓ ﻭﺇﻻ ﻓﻼ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(٩٩‬ﺍﻣﺮﺃﺓ ﺗﺠﻬﻞ ﺑﺴﻦ ﺍﻟﺘﻜﻠﻴﻒ‬ ‫ﺍﻟﺸﺮﻋﻲ ﻭﻣﺎ ﻳﺘﺮﺗﺐ ﻋﻠﻴﻪ ﻣﻦ ﻭﺍﺟﺒﺎﺕ ﻛﻮﺟﻮﺏ ﺍﻟﺼﻮﻡ‬ ‫ﻭﺍﻟﺼﻼﺓ‪ ،‬ﻭﺑﻌﺪ ﺳﻨﻮﺍﺕ ﻣﻦ ﺫﻟﻚ ﻋﻠﻤﺖ ﺑﻮﺟﻮﺑﻬﺎ ﻋﻠﻴﻬﺎ‬ ‫ﻓﻘﺎﻣﺖ ﺑﻘﻀﺎﺀ ﺍﻟﺼﻼﺓ‪ ،‬ﻭﻫﻲ ﺍﻵﻥ ﻣﺎ ﺯﺍﻟﺖ ﻣﺴﺘﻤﺮﺓ‬ ‫ﺑﻘﻀﺎﺀ ﺍﻟﺼﻮﻡ‪ ،‬ﻓﻬﻞ ﻳﺘﺮﺗﺐ ﻋﻠﻴﻬﺎ ﻛﻔﺎﺭﺓ ﺍﻹﻓﻄﺎﺭ‬ ‫ﺍﻟﻤﺘﻌ ‪‬ﻤﺪ ﻟﻠﺴﻨﻮﺍﺕ ﺍﻟﺘﻲ ﻟﻢ ﺗﻌﻠﻢ ﺑﻮﺟﻮﺏ ﺍﻟﺼﻮﻡ ﻋﻠﻴﻬﺎ؟‬ ‫ﻭﻣﺎ ﻣﻘﺪﺍﺭﻫﺎ؟‬ ‫‪ ‬ﻭﺍﻟﻈﺎﻫﺮ ﺍﺧﺘﺼﺎﺹ ﺍﻟﻜﻔﺎﺭﺓ ﺑﻤﻦ‬ ‫ﻛﺎﻥ ﻋﺎ‪‬ﻟﻤﹰﺎ ﺑﻜﻮﻥ ﻣﺎ ﻳﺮﺗﻜﺒﻪ ﻣﻔﻄﺮ‪.‬‬

‫ﺍﻟﺴﻴﺪ ﻣﻘﺘﺪﻯ ﻣﺤﻤﺪ ﺍﻟﺼﺪﺭ )‪(٣٠٣‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٠٠‬ﻃﹶ ‪‬ﺮﻕ ﺳﻤﻌﻲ ﻣﻦ ﺃﺣﺪ ﺍﻹﺧﻮﺍﻥ‬ ‫ﺍﻟﻤﺆﻣﻨﻴﻦ ﺃﻥ ﺍﻟﺴﻴﺪ ﺍﻟﺸﻬﻴﺪ ﻗﺎﻝ ﻣﺎ ﻣﻌﻨﺎﻩ‪) :‬ﺇﻥ ﻓﺪﻳﺔ‬ ‫ﺇﻃﻌﺎﻡ ﺍﻟﻤﺴﻜﻴﻦ ﺍﻟﺘﻲ ﻣﻘﺪﺍﺭﻫﺎ ‪‬ﻣﺪ ﻣﻦ ﻃﺤﻴﻦ ﺍﻟﺤﺼﺔ ﻻ‬ ‫ﺗﻔﻲ ﻹﺷﺒﺎﻋﻪ ﻋﻠﻰ ﺍﻷﻗﻞ ﻧﻔﺮ ﻛﺒﺎﺏ(‪ .‬ﻫﻞ ﻣﻌﻨﻰ ﺫﻟﻚ‬ ‫ﻧﺤﻤﻞ ﻗﻮﻟﻪ‪ ‬ﻋﻠﻰ ﺍﻻﺳﺘﺤﺒﺎﺏ؟‬ ‫‪ ‬ﻛﻼ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٠١‬ﺷﺨﺺ ﺃﺧﺮﺝ ﻣﺎ ﻓﻲ ﺫﻣﺘﻪ ﻣﻦ‬ ‫ﻛﻔﺎﺭﺓ ﺍﻹﻓﻄﺎﺭ ﺍﻟﻤﺘﻌﺪ‪‬ﺩﺓ ﻭﻓﺪﻳﺔ ﺗﺄﺧﻴﺮ ﺍﻟﻘﻀﺎﺀ ﻭﻋﺰﻟﻬﺎ‬ ‫ﻟﺤﻴﻦ ﺇﻳﺼﺎﻟﻬﺎ ﺇﻟﻰ ﺍﻟﺤﺎﻛﻢ ﺍﻟﺸﺮﻋﻲ ﺃﻭ ﻭﻛﻴﻠﻪ ﻟﻌﺪﻡ‬ ‫ﺗﻤﻜﻨﻪ ﻣﻦ ﺻﺮﻓﻬﺎ ﻋﻠﻰ ﺍﻟﻤﺴﺎﻛﻴﻦ ﺑﻨﻔﺴﻪ‪ .‬ﻭﺑﻌﺪ ﺫﻟﻚ ﻟﻢ‬ ‫ﻳﺘﻤﻜﻦ ﻣﻦ ﺇﻳﺼﺎﻟﻬﺎ ﺇﻻ ﺑﻌﺪ ﺳﻨﺔ ﺃﻭ ﺃﻛﺜﺮ ﻟﻌﺬﺭ ﺷﺮﻋﻲ‪.‬‬ ‫ﻓﻬﻞ ﻳﺠﺰﻱ ﺍﻟﻤﺒﻠﻎ ﻧﻔﺴﻪ ﻣﻊ ﺍﺭﺗﻔﺎﻉ ﻗﻴﻤﺔ ﺇﻃﻌﺎﻡ‬ ‫ﺍﻟﻤﺴﻜﻴﻦ ﻓﻲ ﻳﻮﻡ ﺗﺴﻠﻴﻤﻬﺎ ﻋﻦ ﻳﻮﻡ ﺇﺧﺮﺍﺟﻬﺎ؟ ﻭﻫﻞ‬

‫ﻓﻲ ﺿﻴﺎﻓﺔ ﺍﷲ‬ ‫)‪(٣٠٤‬‬ ‫ﺍﻟﺤﺎﻝ ﻧﻔﺴﻪ ﻓﻲ ﺳﺎﺋﺮ ﺍﻟﺤﻘﻮﻕ ﺍﻟﺸﺮﻋﻴﺔ ﺍﻟﺘﻲ ﻳﺤﺼﻞ‬ ‫ﻓﻴﻬﺎ ﻫﺬﺍ ﺍﻟﺘﺒﺎﻳﻦ‪ ،‬ﻭﻻ ﺳﻴﻤﺎ ﺍﻟﺨﻤﺲ ﺍﻻﺑﺘﺪﺍﺋﻲ؟‬ ‫‪ ‬ﻓﻠﻴﺴﺄﻝ ﺍﻟﺤﺎﻛﻢ ﺍﻟﺸﺮﻋﻲ ﺍﻟﺬﻱ ﺃﺭﺍﺩ‬ ‫ﺇﻳﺼﺎﻝ ﺍﻟﻤﺎﻝ ﺇﻟﻴﻪ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٠٢‬ﺇﺫﺍ ﻛﺎﻥ ﻋﻠ ‪‬ﻲ ﺻﻴﺎﻡ ﻛﻔﺎﺭﺓ ﻷﻧﻨـﻲ‬ ‫ﺃﻗﺴﻤﺖ ﻗﺴﻢ ﺛﻢ ﺧﺎﻟﻔﺖ ﻫﺬﺍ ﺍﻟﻘﺴﻢ ﻭﻛﺎﻥ ﻋﻠـﻲ‪ ‬ﻗﻀـﺎﺀ‬ ‫ﺍﻟﺼﻴﺎﻡ‪ ،‬ﻫﻞ ﻳﺠﻮﺯ ﺍﺣﺘﺴﺎﺏ ﺃﻳﺎﻡ ﺍﻟﺼﻴﺎﻡ ﻟﻜﻔﺎﺭﺓ ﺍﻟﻘﺴـﻢ‬ ‫ﻣﻊ ﺃﻳﺎﻡ ﺻﻴﺎﻡ ﺍﻟﻘﻀﺎﺀ؟‬ ‫‪ ‬ﺻﻴﺎﻡ ﺭﻣﻀﺎﻥ ﻭﻗﻀﺎﺋﻪ ﻣﺨﺼﻮﺹ ﻻ‬ ‫ﻳﻤﻜﻦ ﺍﻟﺠﻤﻊ ﻣﻊ ﺷﻲﺀ ﺁﺧﺮ ﺑﻞ ﻣﻄﻠﻘﺎﹰ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٠٣‬ﺷﺨﺺ ﺻﺎﺋﻢ ﻓـﻲ ﺷـﻬﺮ ﺭﻣﻀـﺎﻥ‬ ‫ﺃﺯﻟﻪ ﺍﻟﺸﻴﻄﺎﻥ ﻓﺄﻓﻄﺮ ﺑﺘﻨﺎﻭﻟـﻪ )ﺍﻟﻤـﺎﺀ ﺃﻭ ﺍﻟﻄﻌـﺎﻡ( ﻭﺑﻌـﺪﻫﺎ‬ ‫ﺃﻧﺰﻝ ﺍﻟﻤﻨﻲ )ﺑﺎﻻﺳﺘﻤﻨﺎﺀ(‪ ،‬ﻓﻤﺎ ﻫﻲ ﺍﻟﻜﻔﺎﺭﺓ ﺍﻟﺘﻲ ﺗﺘﺮﺗـﺐ‬ ‫ﻋﻠﻴﻪ؟‬

‫ﺍﻟﺴﻴﺪ ﻣﻘﺘﺪﻯ ﻣﺤﻤﺪ ﺍﻟﺼﺪﺭ )‪(٣٠٥‬‬ ‫‪ ‬ﺍﻷﺣﻮﻁ‪:‬‬ ‫‪ -١‬ﺍﻟﻜﹼﻔﺎﺭﺓ ﺍﻟﻤﺨﻴ‪‬ﺮﺓ‪ ،‬ﻭﻫـﻲ‪ :‬ﻋﺘـﻖ ﺭﻗﺒـﺔ ﺃﻭ ﺻـﻮﻡ‬ ‫ﺷﻬﺮﻳﻦ ﻣﺘﺘﺎﺑﻌﻴﻦ ﺃﻭ ﺇﻃﻌﺎﻡ ﺳﺘﻴﻦ ﻣﺴﻜﻴﻨﹰﺎ‪.‬‬ ‫‪ -٢‬ﻛﻔﹼﺎﺭﺓ ﺍﻟﺠﻤﻊ‪ ،‬ﻭﻫﻲ‪ :‬ﻋﺘﻖ ﺭﻗﺒﺔ ﻭﺻﻮﻡ ﺷﻬﺮﻳﻦ‬ ‫ﻣﺘﺘﺎﺑﻌﻴﻦ ﻭﺇﻃﻌﺎﻡ ﺳﺘﻴﻦ ﻣﺴﻜﻴﻦ‪.‬‬ ‫ﺇﺫﺍ ﻛﺎﻥ ﻋﺎﻟﻤﺎﹰ ﻋﺎﻣﺪﹰﺍ ﻳﻜﻮﻥ ﻣﺎ ﻳﺮﺗﻜﺒﻪ ﻣﻔﻄﺮﺍﹰ ﻭﺇﻻ ﻓﻼ‬ ‫ﺗﺠﺐ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٠٤‬ﻣﺎ ﺣﻜﻢ ﺍﻣﺮﺃﺓ ﺃﺟﺒﺮﻫﺎ ﺯﻭﺟﻬﺎ‬ ‫ﻋﻠﻰ ﺍﻟ ﹺﺠﻤﺎﻉ ﻓﻲ ﺷﻬﺮ ﺭﻣﻀﺎﻥ ﺟﻬﻼﹰ ﻣﻨﻪ ﺑﺎﻟﻜﻔﺎﺭﺓ‪ ،‬ﻭﺑﻌﺪ‬ ‫ﺭﻣﻀﺎﻥ ﺑﺄﻳﺎﻡ ﺗﻮﻓﻰ ﻫﺬﺍ ﺍﻟﺮﺟﻞ‪ ،‬ﻫﻞ ﻳﺠﺐ ﻋﻠﻰ ﺍﻟﻤﺮﺃﺓ‬ ‫ﺍﻟﻘﻀﺎﺀ ﻭﺍﻟﻜﻔﺎﺭﺓ ﻋﻦ ﻛﻠﻴﻬﻤﺎ ﺃﻡ ﻣﺎﺫﺍ ﺗﻔﻌﻞ؟‬ ‫‪ ‬ﻛﻼ ﻻ ﻳﺠﺐ‪ ...‬ﻻ ﺷﻲﺀ ﻋﻠﻴﻬﺎ ﺇﻻ‬ ‫ﺍﻟﻘﻀﺎﺀ ﻋﻠﻰ ﺍﻷﺣﻮﻁ‪.‬‬

‫ﻓﻲ ﺿﻴﺎﻓﺔ ﺍﷲ‬ ‫)‪(٣٠٦‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٠٥‬ﻓﻲ ﻳﻮﻡ ﻣﻦ ﺃﻳﺎﻡ ﺭﻣﻀﺎﻥ ﺍﻟﻤﺒﺎﺭﻙ‬ ‫ﺍﺳﺘﻴﻘﻈﺖ ﻭﻗﺖ ﺍﻟﺴﺤﻮﺭ ﻹﺣﻀﺎﺭ ﺍﻟﻄﻌـﺎﻡ ﺃﻛﻠـﺖ ﻗﻠﻴـﻞ‬ ‫ﻣﻦ ﺍﻟﻄﻌﺎﻡ ﻓﻲ ﺃﺛﻨﺎﺀ ﺍﺣﻀﺎﺭﻩ‪ ،‬ﺑﻌﺪﻫﺎ ﺍﻧﺘﺒﻬﺖ ﺑـﺄﻥ ﻭﻗـﺖ‬ ‫ﺍﻷﺫﺍﻥ ﻗﺪ ﺣﺎﻥ‪ ،‬ﺑﻘﻴﺖ ﻋﻠﻰ ﺻـﻴﺎﻣﻲ‪ .‬ﻫـﻞ ﻳﻌﺘﺒـﺮ ﺇﻓﻄـﺎﺭ‬ ‫ﻣﺘﻌﻤﺪ ﺃﻡ ﻏﻴﺮ ﻣﺘﻌﻤﺪ‪ ،‬ﺇﺫﺍ ﻛﺎﻥ ﻣﺘﻌﻤﺪﹰﺍ ﻣﺎﺫﺍ ﻋﻠﻲ‪ ‬ﻓﻌﻠﻪ؟‬ ‫‪ ‬ﻣــﻨﻬﺞ ﺍﻟﺼــﺎﻟﺤﻴﻦ ﺝ‪ ٢‬ﺹ‪...٢٢‬‬ ‫ﺍﻟﺮﺍﺑﻊ‪.(١)...:‬‬ ‫)‪) (١‬ﻣﺴﺄﻟﺔ ‪ (٦٩‬ﻳﺠﺐ ﺍﻟﻘﻀﺎﺀ ﺩﻭﻥ ﺍﻟﻜﻔﺎﺭﺓ‪...:‬‬ ‫ﺍﻟﺮﺍﺑﻊ‪ :‬ﺇﺫﺍ ﺍﺳﺘﻌﻤﻞ ﺍﻟﻤﻔﻄﺮ ﺑﻌﺪ ﻃﻠﻮﻉ ﺍﻟﻔﺠﺮ ﺑﺪﻭﻥ ﻣﺮﺍﻋﺎﺓ‪،‬‬ ‫ﻭﻻ ﺣ‪‬ﺠﺔ ﻋﻠﻰ ﻃﻠﻮﻋﻪ‪ .‬ﺃﻣﺎ ﺇﺫﺍ ﻗﺎﻣﺖ ﺣ‪‬ﺠﺔ ﻋﻠﻰ ﻃﻠﻮﻋﻪ‬ ‫ﻭﺟﺐ ﺍﻟﻘﻀﺎﺀ ﻭﺍﻟﻜﻔﺎﺭﺓ‪ ،‬ﻣﺎ ﻟﻢ ﻳﺜﺒﺖ ﺍﻟﺨﻼﻑ ﺑﻌﺪ ﺫﻟﻚ‪.‬‬ ‫ﻭﺇﺫﺍ ﻛﺎﻥ ﻣﻊ ﺍﻟﻤﺮﺍﻋﺎﺓ‪ ،‬ﻭﺍﻋﺘﻘﺎﺩ ﺑﻘﺎﺀ ﺍﻟﻠﻴﻞ‪ ،‬ﻓﻼ ﻗﻀﺎﺀ ﻭﻻ‬ ‫ﻛﻔﺎﺭﺓ‪ .‬ﺳﻮﺍﺀ ﺃﺧﺒﺮ ﻣﺨﺒﺮ ﺑﺒﻘﺎﺀ ﺍﻟﻠﻴﻞ ﺃﻡ ﺃﺧﺒﺮ ﺑﻄﻠﻮﻉ ﺍﻟﻔﺠﺮ‬ ‫ﻭﺍﻋﺘﻘﺪ ﺳﺨﺮﻳﺘﻪ‪ ،‬ﻫﺬﺍ ﺇﺫﺍ ﻛﺎﻥ ﺻﻮﻡ ﺭﻣﻀﺎﻥ ﻭﻓﻲ ﺇﻟﺤﺎﻕ=‬

‫ﺍﻟﺴﻴﺪ ﻣﻘﺘﺪﻯ ﻣﺤﻤﺪ ﺍﻟﺼﺪﺭ )‪(٣٠٧‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٠٦‬ﺃﺧﺘﻲ ﺃﻓﻄﺮﺕ ﺃﻳﺎﻡ ﻻ ﺗﺘﺬﻛﺮ ﻛﻢ‬ ‫ﻋﺪﺩﻫﺎ ﻓﻲ ﺷﻬﺮ ﺭﻣﻀﺎﻥ ﻓﻲ ﺃﻳﺎﻡ ﺍﻟﺪﺭﺍﺳﺔ ﻗﺒﻞ ﻋﺸـﺮﻭﻥ‬ ‫ﺳﻨﺔ ﺗﻘﺮﻳﺒﺎﹰ‪ ،‬ﻭﻛﺎﻧـﺖ ﺟﺎﻫﻠـﺔ ﺑﺤﻜـﻢ ﺍﻹﻓﻄـﺎﺭ ﻓـﻲ ﻫـﺬﺍ‬ ‫ﺍﻟﺸﻬﺮ ﺍﻟﻤﺒﺎﺭﻙ‪ ،‬ﻣﺎﺫﺍ ﻋﻠﻴﻬﺎ ﻓﻌﻠﻪ ﻭﻣﺎ ﺍﻟﺤﻜﻢ ﺍﻟﺸﺮﻋﻲ ﻓﻲ‬ ‫ﺫﻟﻚ؟‬ ‫‪ ‬ﻫﺬﺍ ﻋﺎﺋﺪ ﺇﻟﻰ ﻛﻴﻔﻴﺔ ﺍﻹﻓﻄﺎﺭ ﻫﻞ ﻫﻮ‬ ‫ﺍﻟﻤﺘﻌﻤﺪ ﺃﻡ ﻏﻴﺮ ﺫﻟﻚ ﻭﻫﻞ ﻫﻮ ﺑﻌﺬﺭ ﺃﻡ ﻏﻴﺮ ﺫﻟﻚ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٠٧‬ﺍﻟﺰﻭﺟﺔ ﻭﺍﺟﺒﺔ ﺍﻟﻨﻔﻘﺔ ﻫﻞ ﺗﺠﺐ‬ ‫ﻓﺪﻳﺘﻬﺎ ﻟﻠﺼﻮﻡ ﺍﻟﻔﺎﺋﺖ ﻋﻠﻰ ﺯﻭﺟﻬﺎ ﺃﻭ ﻋﻠﻰ ﻧﻔﺴﻬﺎ؟‬ ‫‪ ‬ﻣﻨﻬﺞ ﺍﻟﺼﺎﻟﺤﻴﻦ ﺝ‪) ٤‬ﻣﺴـﺄﻟﺔ‪:(٣٧٨‬‬ ‫=ﺍﻟﻮﺍﺟﺐ ﺍﻟﻤﻌﻴ‪‬ﻦ ﺑﻪ ﺇﺷﻜﺎﻝ‪ ،‬ﻭﺍﻷﺣﻮﻁ ﺍﻹﺗﻤﺎﻡ ﻭﺍﻟﻘﻀﺎﺀ‬ ‫ﻭﻓﻲ ﻏﻴﺮﻩ ﻣﻦ ﺃﻧﻮﺍﻉ ﺍﻟﺼﻮﻡ ﺍﻟﻮﺍﺟﺐ ﻭﺍﻟﻤﻨﺪﻭﺏ ﺍﻟﺒﻄﻼﻥ‪ ،‬ﺇﻻ‬ ‫ﺇﺫﺍ ﻛﺎﻥ ﻣﻮﺭﺩﺍﹰ ﻻﺳﺘﺼﺤﺎﺏ ﺑﻘﺎﺀ ﺍﻟﻠﻴﻞ‪.‬‬

‫ﻓﻲ ﺿﻴﺎﻓﺔ ﺍﷲ‬ ‫)‪(٣٠٨‬‬ ‫))ﻻ ﻳﺠﺐ ﻋﻠﻰ ﺍﻟﺰﻭﺝ ﺃﺩﺍﺀ ﺍﻟﻮﺍﺟﺒـﺎﺕ ﺃﻭ ﺍﻟﻤﺴـﺘﺤﺒﺎﺕ‬ ‫ﺍﻟﻤﺎﻟﻴﺔ ﻋﻦ ﺍﻟﺰﻭﺟﺔ ﻛﺎﻟﻔﺪﻳﺔ ﻭﺍﻟﻜﻔـﺎﺭﺓ ﻭﻓـﺪﺍﺀ ﺍﻹﺣـﺮﺍﻡ‬ ‫ﻭﺍﻻﺭﺵ ﻭﺍﻟﺪﻳﺔ ﻭﻏﻴﺮﻫﺎ‪ ،‬ﻣﻤﺎ ﻻ ﺗﻘﻮﻡ ﺑﻬﺎ ﺣﻴﺎﺗﻬﺎ((‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٠٨‬ﻛﻤـﺎ ﺗﻌﻠـﻢ ﺳـﻤﺎﺣﺘﻚ ﺃﻥ ﻣﻮﻋـﺪ‬ ‫ﺍﻣﺘﺤﺎﻧﺎﺕ ﺍﻟﺒﻜﻠﻮﺭﻳﺎ ﺳﺘﺼﺎﺩﻑ ﻓﻲ ﺃﻳـﺎﻡ ﺷـﻬﺮ ﺭﻣﻀـﺎﻥ‬ ‫ﺍﻟﻤﺒﺎﺭﻙ‪ ،‬ﻓﻬﻞ ﻣﻦ ﻳﻔﻄـﺮ ﻋﻠﻴـﻪ ﻗﻀـﺎﺀ ﻭﻛﻔـﺎﺭﺓ ﺃﻡ ﻓﻘـﻂ‬ ‫ﺍﻟﻘﻀﺎﺀ؟‬ ‫‪ ‬ﻳﺠــﺐ ﺻــﻴﺎﻡ ﺷــﻬﺮ ﺭﻣﻀــﺎﻥ‪...‬‬ ‫ﻭﺍﻹﻓﻄﺎﺭ ﺍﻟﻤﺘﻌﻤـﺪ ﻣﻮﺟـﺐ ﻟﻠﻘﻀـﺎﺀ ﻭﺍﻟﻜﻔـﺎﺭﺓ ﻭﺯﻳـﺎﺩﺓ‬ ‫ﺍﻵﺛﺎﻡ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٠٩‬ﻓـﻲ ﻛﻔـﺎﺭﺓ ﺇﻓﻄـﺎﺭ ﻳـﻮﻡ ﻣـﻦ ﺷـﻬﺮ‬ ‫ﺭﻣﻀﺎﻥ ﻫﻞ ﻳﺠﺰﻱ ﻓﻲ ﺇﻃﻌـﺎﻡ ﺳـﺘﻴﻦ ﻣﺴـﻜﻴﻦ ﺍﻟﺘﺴـﻠﻴﻢ‬ ‫ﻟﻜﻞ ﻭﺍﺣﺪ ﻣ‪‬ﺪ ﺃﻡ ﻻ ﻳﻜﻔﻲ ﻭﻻ ﻳﺠﺰﻱ ﺇﻻ ﻭﺟﺒﺔ ﻣﺸﺒﻌﺔ‬

‫ﺍﻟﺴﻴﺪ ﻣﻘﺘﺪﻯ ﻣﺤﻤﺪ ﺍﻟﺼﺪﺭ )‪(٣٠٩‬‬ ‫ﻟﻜﻞ ﻣﺴﻜﻴﻦ؟ ﻓﻘﺪ ﺭﺍﺟﻌﺖ ﻣـﻨﻬﺞ ﺍﻟﺼـﺎﻟﺤﻴﻦ ﺝ‪ ٢‬ﻓـﻲ‬ ‫ﻣﺴـﺄﻟﺔ ‪ ٤٩‬ﻭ ‪ ٦٣‬ﻭ ‪ ٦٨‬ﻓﻠـﻢ ﺃﺟـﺰﻡ ﺑﺎﻟﻨﺘﻴﺠـﺔ‪ ،‬ﻭﻛـﺬﻟﻚ‬ ‫ﺑﻌﺾ ﻃﻠﺒﺔ ﺍﻟﻌﻠﻢ ﺃﺟﻮﺑﺘﻬﻢ ﻣﺘﺒﺎﻳﻨﺔ ﻓﻲ ﺍﻟﻤﻮﺿﻮﻉ‪.‬‬ ‫‪ ‬ﺭﺍﺟـﻊ ﻣﺴـﺄﻟﺔ )‪ (١)(٤٩‬ﻣـﻦ ﺝ‪ ٢‬ﻣـﻦ‬ ‫ﻣﻨﻬﺞ ﺍﻟﺼﺎﻟﺤﻴﻦ ﺗﺤﺖ ﻋﻨﻮﺍﻥ ﻛﻔﺎﺭﺓ ﺍﻟﺼﻮﻡ‪.‬‬ ‫)‪) (١‬ﻣﺴﺄﻟﺔ ‪)) :(٤٩‬ﻛﻔﺎﺭﺓ ﺇﻓﻄﺎﺭ ﻳﻮﻡ ﻣﻦ ﺷﻬﺮ ﺭﻣﻀﺎﻥ ﻣﺨﻴﺮﺓ‬ ‫ﺑﻴﻦ ﻋﺘﻖ ﺭﻗﺒﺔ ﻭﺻﻮﻡ ﺷﻬﺮﻳﻦ ﻣﺘﺘﺎﺑﻌﻴﻦ ﻭﺇﻃﻌﺎﻡ ﺳﺘﻴﻦ ﻣﺴﻜﻴﻨﹰﺎ‬ ‫ﻟﻜﻞ ﻣﺴﻜﻴﻦ ﻣ‪‬ﺪ ﻭﻫﻮ ﻳﺴﺎﻭﻱ ﺛﻼﺛﺔ ﺃﺭﺑﺎﻉ ﺍﻟﻜﻴﻠﻮ‪ ،‬ﻭﻛﻔﺎﺭﺓ‬ ‫ﺇﻓﻄﺎﺭ ﻗﻀﺎﺀ ﺷﻬﺮ ﺭﻣﻀﺎﻥ ﺑﻌﺪ ﺍﻟﺰﻭﺍﻝ ﺇﻃﻌﺎﻡ ﻋﺸﺮﺓ ﻣﺴﺎﻛﻴﻦ‬ ‫ﻟﻜﻞ ﻣﺴﻜﻴﻦ ﻣ‪‬ﺪ‪ ،‬ﻓﺈﻥ ﻟﻢ ﻳﺘﻤ ﱠﻜﻦ ﺻﺎﻡ ﺛﻼﺛﺔ ﺃﻳﺎﻡ‪ .‬ﻭﻛﻔﺎﺭﺓ‬ ‫ﺇﻓﻄﺎﺭ ﺍﻟﺼﻮﻡ ﺍﻟﻤﻨﺬﻭﺭ ﺍﻟﻤﻌﻴﻦ ﻛﻔﺎﺭﺓ ﻳﻤﻴﻦ‪ .‬ﻭﻫﻲ ﻋﺘﻖ ﺭﻗﺒﺔ‬ ‫ﺃﻭ ﺇﻃﻌﺎﻡ ﻋﺸﺮﺓ ﻣﺴﺎﻛﻴﻦ ﻟﻜﻞ ﻭﺍﺣﺪ ‪‬ﻣﺪ ﺃﻭ ﻛﺴﻮﺓ ﻋﺸﺮﺓ‬ ‫ﻣﺴﺎﻛﻴﻦ‪ ،‬ﻓﺈﻥ ﻋﺠﺰ ﺻﺎﻡ ﺛﻼﺛﺔ ﺃﻳﺎﻡ‪ ،‬ﻭﺍﻷﺣﻮﻁ ﻭﺟﻮﺑﹰﺎ ﺃﻥ‬ ‫ﻳﻜﻮﻥ ﺑﺪﻝ ﺍﻟﻤ‪‬ﺪ ﻭﺟﺒﺔ ﻃﻌﺎﻡ ﻣﺸﺒﻌﺔ‪.‬‬

‫ﻓﻲ ﺿﻴﺎﻓﺔ ﺍﷲ‬ ‫)‪(٣١٠‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١١٠‬ﻫﻞ ﻳﺠﻮﺯ ﻓﻲ ﻛﻔﺎﺭﺓ ﺇﻓﻄﺎﺭ ﻳﻮﻡ‬ ‫ﻣﻦ ﺷﻬﺮ ﺭﻣﻀﺎﻥ‪ ،‬ﻋﻨﺪﻣﺎ ﻳﺮﺍﺩ ﺇﻃﻌﺎﻡ ﺳﺘﻴﻦ ﻣﺴﻜﻴﻨﹰﺎ‬ ‫ﺍﻟﺘﺴﻠﻴﻢ ﺇﻟﻴﻬﻢ ﻣﻦ ﺍﻟﻄﻌﺎﻡ ﻏﻴﺮ ﺍﻟﻤﻄﺒﻮﺥ ﺑﺤﻴﺚ ﻟﻮ ﻃﺒﺨﻪ‬ ‫ﺍﻟﻤﺴﻜﻴﻦ ﻷﺷﺒﻌﻪ‪ ،‬ﻣﺜﻞ ﺍﻟﺮﺯ ﻭﺍﻟﻄﺤﻴﻦ‪ .‬ﺃﻡ ﻳﺸﺘﺮﻁ‬ ‫ﺍﻟﺘﺴﻠﻴﻢ ﺇﻟﻴﻬﻢ ﻃﻌﺎﻣﹰﺎ ﻣﻄﺒﻮﺧﺎﹰ ﻛﺎﻟﺨﺒﺰ ﺃﻭ ﻗﺎﺑﻞ ﻟﻸﻛﻞ‬ ‫ﺑﺪﻭﻥ ﻃﺒﺦ ﻛﺎﻟﺘﻤﺮ؟‬ ‫‪  ‬ﻣﺴﺄﻟﺔ ‪ ٤٩‬ﻣﻦ ﻣﻨﻬﺞ ﺍﻟﺼﺎﻟﺤﻴﻦ‬ ‫ﺝ‪.٢‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١١١‬ﺍﻟﺸﺨﺺ ﺍﻟـﺬﻱ ﻻ ﻳﺴـﺘﻄﻴﻊ ﻗﻀـﺎﺀ‬ ‫ﺻﻮﻡ ﺃﻳﺎﻡ ﻟﻢ ﻳﺴﺘﻄﻊ ﺻﻴﺎﻣﻬﺎ ﻓﻲ ﺭﻣﻀﺎﻥ ﺑﺴﺒﺐ ﻣـﺮﺽ‬ ‫ﻭﻳﺮﻳﺪ ﺇﻋﻄﺎﺀ ﺍﻟﻔﺪﻳﺔ ﺑﺎﻟﻤﻘﺎﺑﻞ ﻫﻞ ﻳﺠﻮﺯ ﺇﻋﻄـﺎﺀ ﺍﻟﻨﻘـﻮﺩ‬ ‫ﺑﺪﻝ ﺍﻷﺷﻴﺎﺀ ﺍﻟﻌﻴﻨﻴﺔ ﻛﺎﻟﻄﺤﻴﻦ ﻭﻏﻴﺮﻫﺎ ﻭﻓﻲ ﻫﺬﺍ ﺍﻟﻮﻗـﺖ‬ ‫ﺍﻟﻔﻘـﺮﺍﺀ ﺍﻟﻤﺴـﺘﺤﻘﻴﻦ ﺑﺤﺎﺟـﺔ ﺇﻟـﻰ ﺍﻟﻤـﺎﻝ ﺑـﺪﻝ ﺍﻟﻄﻌـﺎﻡ‬

‫ﻓﻲ ﺿﻴﺎﻓﺔ ﺍﷲ‬ ‫)‪(٣١٢‬‬ ‫‪ ‬‬ ‫‪ ‬‬ ‫ﻣﺴﺄﻟﺔ )‪) :(١١٣‬ﻣﺴـﺎﻟﺔ ‪)) :(١)(٨٤‬ﺇﺫﺍ ﺳـﺎﻓﺮ ﻗﺒـﻞ‬ ‫ﺍﻟﺰﻭﺍﻝ ﻭﻛﺎﻥ ﻧﺎﻭﻳﺎﹰ ﻟﻠﺴﻔﺮ ﻣﻦ ﺍﻟﻠﻴﻞ ﻭﺟﺐ ﻋﻠﻴﻪ ﺍﻹﻓﻄـﺎﺭ‬ ‫ﻭﺍﻟﻘﻀﺎﺀ‪ .‬ﺑـﻞ ﺍﻷﻗـﻮﻯ ﺫﻟـﻚ ﻭﺇﻥ ﻟـﻢ ﻳﻜـﻦ ﻧﺎﻭﻳـﹰﺎ ﻟـﻴ ﹰﻼ‪.‬‬ ‫ﻭﻳﻜـﻮﻥ ﻭﺟـﻮﺏ ﺇﺗﻤـﺎﻡ ﺻـﻮﻣﻪ ﻳﻮﻣـﻪ ﺫﺍﻙ ﻣﺒﻨﻴـﺎﹰ ﻋﻠـﻰ‬ ‫ﺍﻻﺣﺘﻴـﺎﻁ ﺍﻻﺳـﺘﺤﺒﺎﺑﻲ‪ .‬ﻭﺇﻥ ﻛـﺎﻥ ﺍﻟﺴـﻔﺮ ﺑﻌـﺪ ﺍﻟـﺰﻭﺍﻝ‬ ‫ﻭﺟﺐ ﺇﺗﻤﺎﻡ ﺍﻟﺼﻴﺎﻡ ﻭﺻﺢ ﻣﻨﻪ((‪ .‬ﺣﻴﺚ ﺍﺳﺘﻮﻗﻔﺘﻨﻲ ﻫﺬﻩ‬ ‫ﺍﻟﻤﺴﺎﻟﺔ ﻭﻟـﻢ ﺃﺳـﺘﻄﻊ ﺣـﻞ ﻟﻐﺰﻫـﺎ‪ ،‬ﻭﻫـﻮ ﻛﻴـﻒ ﻭﺟـﺐ‬ ‫ﺍﻹﻓﻄــﺎﺭ ﻭﻛﻴــﻒ ﻳﻜــﻮﻥ ﺇﺗﻤــﺎﻡ ﺍﻟﺼــﻮﻡ ﻣﺒﻨــﻲ ﻋﻠــﻰ‬ ‫)‪ (١‬ﻣﻨﻬﺞ ﺍﻟﺼﺎﻟﺤﻴﻦ ﺝ‪ ٢‬ﺹ‪.٢٨‬‬

‫ﺍﻟﺴﻴﺪ ﻣﻘﺘﺪﻯ ﻣﺤﻤﺪ ﺍﻟﺼﺪﺭ )‪(٣١٣‬‬ ‫ﺍﻻﺣﺘﻴﺎﻁ ﺍﻻﺳﺘﺤﺒﺎﺑﻲ؟‬ ‫‪ ‬ﻫﺬﺍ ﻛﻠـﻪ ﻣـﻦ ﺻـﻼﺣﻴﺎﺕ ﺍﻟﻔﻘﻴـﻪ‪...‬‬ ‫ﻋﻠﻴﻚ ﺍﻟﺘﻄﺒﻴﻖ ﻓﻘﻂ ﻭﺍﻟﻄﺎﻋﺔ ﻻ ﻏﻴﺮ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١١٤‬ﻣﺎ ﻫﻮ ﺣﻜﻢ ﻣـﻦ ﺃﺭﺍﺩ ﺍﻟﺴـﻔﺮ ﻓـﻲ‬ ‫ﺷـﻬﺮ ﺭﻣﻀـﺎﻥ ﻭﻗﻄـﻊ ﺍﻟﻤﺴ ـﺎﻓﺔ ﺍﻟﺸـﺮﻋﻴﺔ ﻭﻫـﻮ ﻗﺎﺻ ـﺪ‬ ‫ﻟﻠﺮﺟﻮﻉ ﺇﻟﻰ ﻭﻃﻨﻪ ﻗﺒﻞ ﺍﻟﺰﻭﺍﻝ ﻭﻭﺻﻞ ﺇﻟﻴﻪ ﻗﺒﻞ ﺍﻟﺰﻭﺍﻝ‪،‬‬ ‫ﻫﻞ ﻳﺠﺐ ﻋﻠﻴﻪ ﺍﻹﻓﻄﺎﺭ ﺃﻡ ﻳﺴﺘﻤﺮ ﺑﺼﻴﺎﻣﻪ؟‬ ‫‪ ‬ﺇﺫﺍ ﻟﻢ ﻳﺘﻨـﺎﻭﻝ ﺍﻟﻤﻔﻄـﺮ ﻓﻌﻠﻴـﻪ ﺇﺗﻤـﺎﻡ‬ ‫ﺻﻮﻣﻪ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١١٥‬ﻫﻞ ﻳﺠﺐ ﺍﻟﻘﺼﺮ ﻭﺍﻹﻓﻄـﺎﺭ ﻋﻠـﻰ‬ ‫ﺍﻟﻤﻮﻇـﻒ ﺍﻟﻤﻮﻓـﺪ ﺇﻟـﻰ ﻣﺪﻳﻨـﺔ ﺃﺧـﺮﻯ ﺑﻌﻴـﺪﺓ ﺇﻥ ﻛـﺎﻥ‬ ‫ﺇﻳﻔﺎﺩﻩ ﺩﻭﻥ ﺍﻟﻌﺸﺮﺓ ﺃﻳﺎﻡ‪ ،‬ﺣﻴﺚ ﺃﺧﺒﺮﻧﻲ ﺃﺣـﺪ ﺍﻟﻤﺸـﺎﻳﺦ‬ ‫ﺃﻥ ﺍﻟﺴــﻴﺪ ﺍﻟﺸــﻬﻴﺪ‪ ‬ﻳﺠﻴــﺰ‪ ..‬ﺃﻭ ﻳﻮﺟــﺐ ﺍﻹﺗﻤــﺎﻡ‬

‫ﻓﻲ ﺿﻴﺎﻓﺔ ﺍﷲ‬ ‫)‪(٣١٤‬‬ ‫ﻭﺍﻟﺼﻮﻡ ﻓﻲ ﻫﺬﻩ ﺍﻟﺤﺎﻟﺔ‪.‬‬ ‫‪ ‬ﺇﺫﺍ ﻛﺎﻥ ﺩﺍﺧـﻼﹰ ﺗﺤـﺖ ﻧﻄـﺎﻕ ﻋﻤﻠـﻪ‬ ‫ﻓﻴﻮﺟﺐ ﺍﻹﺗﻤﺎﻡ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١١٦‬ﻟﻮ ﺳﺎﻓﺮ ﺍﻟﺼﺎﺋﻢ ﺑﻌـﺪ ﺍﻟـﺰﻭﺍﻝ ﻓـﻲ‬ ‫ﻧﻬﺎﺭ ﺻﻮﻡ ﺷﻬﺮ ﺭﻣﻀﺎﻥ ﻫﻞ ﻳﺠﻮﺯ ﻟﻪ ﺍﻹﻓﻄﺎﺭ؟‬ ‫‪ ‬ﻛﻼ‪ ،‬ﺇﻻ ﻣﻊ ﺍﻻﺿﺮﺍﺭ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١١٧‬ﺱ‪ :١‬ﺇﺫﺍ ﻛﺎﻥ ﺍﻟﺴﻔﺮ ﺑﻌـﺪ ﺍﻟـﺰﻭﺍﻝ‬ ‫ﻓﻲ ﻗﻀﺎﺀ ﺷﻬﺮ ﺭﻣﻀﺎﻥ‪ ،‬ﻓﻬﻞ ﻳﺠﻮﺯ ﺍﻹﻓﻄﺎﺭ؟‬ ‫‪ ‬ﻛﻼ‪ ،‬ﺑﻞ ﻳﺒﻘﻰ ﻋﻠﻰ ﺻﻴﺎﻣﻪ‪.‬‬ ‫ﺱ‪ :٢‬ﻭﺇﺫﺍ ﻛـﺎﻥ ﺍﻟﺴـﻔﺮ ﺑﻌـﺪ ﺍﻟـﺰﻭﺍﻝ ﻓـﻲ ﺍﻟﺼـﻮﻡ‬ ‫ﺍﻟﻤﺴﺘﺤﺐ؟‬ ‫‪ ‬ﺍﻟﻤﺴﺘﺤﺐ ﻳﺒﻘﻰ ﻣﺴﺘﺤﺐ‪ .‬ﻭﺇﻥ ﺷﺎﺀ‬ ‫ﺍﺳﺘﻤﺮ ﻭﺇﻥ ﺷﺎﺀ ﺃﻓﻄﺮ‪.‬‬

‫ﺍﻟﺴﻴﺪ ﻣﻘﺘﺪﻯ ﻣﺤﻤﺪ ﺍﻟﺼﺪﺭ )‪(٣١٥‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١١٨‬ﻟﻮ ﺭﺟﻊ ﺍﻟﻤﺴﺎﻓﺮ ﺇﻟﻰ ﻭﻃﻨﻪ )ﻣﺤﻞ‬ ‫ﺍﻟﺴﻜﻦ ﻛﻤﺎ ﻟﻮ ﻛﺎﻥ ﺍﻟﻨﺠﻒ( ﺑﺎﻟﻄـﺎﺋﺮﺓ ﻭﺃﺭﺍﺩ ﺃﻥ ﻳﺠـﺪﺩ‬ ‫ﻧﻴﺔ ﺻﻴﺎﻣﻪ‪ ،‬ﻓﻬﻞ ﻳﻨﺘﻈﺮ ﻧﺰﻭﻟﻪ ﺇﻟﻰ ﺍﻟﻤﻄﺎﺭ ﻛﻲ ﻳﺠﺪﺩ ﻧﻴﺘﻪ‬ ‫ﺃﻭ ﺑﻤﺠﺮﺩ ﺩﺧﻮﻟﻪ ﺍﻷﺟﻮﺍﺀ؟‬ ‫‪  ‬ﻫـﺬﺍ ﻳﺨﺘﻠـﻒ ﺑـﺎﺧﺘﻼﻑ ﺍﻟ ‪‬ﻤـﺪﻥ‬ ‫ﻭﻣﺴﺎﺣﺎﺗﻬﺎ ﻭﺑﻴﻦ ﺇﺫﺍ ﻛﺎﻥ ﺍﻟﻤﻄﺎﺭ ﻓﻲ ﻧﻔﺲ ﻣﺪﻳﻨﺘﻪ ﺃﻡ ﻻ‬ ‫ﻭﻓﻴﻤﺎ ﺇﺫﺍ ﻛﺎﻥ ﺍﻟﻤﺮﻭﺭ ﻋﻠﻰ ﻣﺪﻳﻨﺘﻪ ﻗﺒﻞ ﺍﻟﻬﺒـﻮﻁ ﺑﻮﻗـﺖ‬ ‫ﻣﻌﺘﺪ ﺑﻪ ﺃﻡ ﻻ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١١٩‬ﺷﺨﺺ )ﻋﻤﻠﻪ ﺍﻟﺮﺋﻴﺴﻲ( ﻣﻮﻇـﻒ‬ ‫ﻋﻤﻠﻪ ﻓﻲ ﺍﻟﺴﻔﺮ ﻭﻛﺬﻟﻚ ﻫﻮ ﻓﻲ ﻧﻔـﺲ ﺍﻟﻮﻗـﺖ ﻳـﺪﺭﺱ‬ ‫)ﻃﺎﻟـﺐ( ﻓـﻲ ﺑﻠـﺪ‪ ‬ﺁﺧـﺮ‪ ،‬ﻓﻬـﻞ ﻳـﺘﻢ ﻭﻳﺼـﻮﻡ ﻓـﻲ ﻣﻘـﺮ‬ ‫ﺍﻟﺪﺭﺍﺳﺔ؟‬ ‫‪ ‬ﻧﻌﻢ‪.‬‬

‫ﻓﻲ ﺿﻴﺎﻓﺔ ﺍﷲ‬ ‫)‪(٣١٦‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٢٠‬ﺱ‪ :١‬ﺃﻧﺎ ﺃﻋﻤﻞ ﻓﻲ ﺇﺣﺪﻯ ﺩﻭﺍﺋـﺮ‬ ‫ﺍﻟﺪﻭﻟﺔ ﻭﻓﻲ ﻣﻨﻄﻘﺔ ﺗﺒﻌﺪ ﻋـﻦ ﺍﻟﺒﻴـﺖ ﺍﻟﺴـﻜﻦ ‪ ٣٢‬ﻛﻴﻠـﻮ‬ ‫ﻣﺘـﺮ‪ ،‬ﻭﺇﻥ ﺩﻭﺍﻣـﻲ ﻓـﻲ ﻫـﺬﻩ ﺍﻟـﺪﺍﺋﺮﺓ ﻛـﻞ ﻳـﻮﻣﻴﻦ ﻓـﻲ‬ ‫ﻳﻮﻣﻴﻦ‪ ،‬ﻭﻗﻤﺖ ﺑﺼﻴﺎﻡ ﻭﺍﺟﺐ ﺃﻡ ﻣﺴﺘﺤﺐ ﻭﻋﻨﺪﻣﺎ ﺻـﺎﺭ‬ ‫ﻧﺰﻭﻟﻲ ﺫﻫﺒﺖ ﺇﻟﻰ ﻣﻨﻄﻘﺔ ﻓﻴﻬـﺎ ﺃﻗـﺎﺭﺑﻲ ﺍﻟـﺬﻱ ﺗﻘـﻊ ﻓـﻲ‬ ‫ﻧﻔـﺲ ﺍﻟﻄﺮﻳـﻖ ﻭﺗﺒﻌـﺪ ﻋـﻦ ﺍﻟﺒﻴـﺖ ﺗﻘﺮﻳﺒـﹰﺎ ‪ ٢‬ﻛﻴﻠـﻮ ﻣﺘـﺮ‬ ‫ﻭﺑﻘﻴﺖ ﻋﻨﺪ ﺃﻗﺎﺭﺑﻲ ﺇﻟﻰ ﺑﻌـﺪ ﺯﻭﺍﻝ ﺍﻟﺸـﻤﺲ‪ .‬ﻣـﺎ ﺣﻜـﻢ‬ ‫ﺻﻴﺎﻡ ﺍﻟﻮﺍﺟﺐ ﺃﻭ ﺍﻟﻤﺴﺘﺤﺐ؟‬ ‫‪ ‬ﺇﺫﺍ ﻟﻢ ﻳ‪ ‬ﻚ ﺍﻟﻤﻜﺚ ﻃﻮﻳﻼﹰ ﻓﺎﻟﺘﻤﺎﻡ‪.‬‬ ‫ﺱ‪ :٢‬ﻭﻫﻞ ﻳﻌﺘﺒﺮ ﺩﻭﺍﻣﻲ ﻫﺬﺍ ﻛﺜﻴﺮ ﺍﻟﺴﻔﺮ؟‬ ‫‪ ‬ﺣﺴﺐ ﺍﻟﻈﺎﻫﺮ ﻧﻌﻢ ﻟﻜﻦ ﻻ ﻣﺪﺧﻠﻴـﺔ‬ ‫ﻟﻪ ﻓﻲ ﺳﺆﺍﻟﻚ ﺍﻟﺴﺎﺑﻖ‪.‬‬ ‫ﺱ‪ :٣‬ﻭﻣﺎ ﻋﺪﺩ ﺃﻳﺎﻡ ﺍﻟﺴﻔﺮ ﻓﻲ ﺍﻟﺸﻬﺮ؟‬ ‫‪ ‬ﺇﻥ ﻗﺼـﺪﺕ ﻛﺜﻴـﺮ ﺍﻟﺴـﻔﺮ ﻓﻴﻘـﺎﺱ‬

‫ﺍﻟﺴﻴﺪ ﻣﻘﺘﺪﻯ ﻣﺤﻤﺪ ﺍﻟﺼﺪﺭ )‪(٣١٧‬‬ ‫ﺑﺎﻷﺳﺒﻮﻉ ﺛﻢ ﻣﻨﻪ ﻋﻠﻰ ﺍﻟﺸﻬﺮ‪.‬‬ ‫ﺱ‪ :٤‬ﻭﺇﻥ ﻗﺎﻋﺪﺓ ﻛﺜﻴﺮ ﺍﻟﺴـﻔﺮ ﺗﻨﻄﺒـﻖ ﻋﻠـﻰ ﻋﻤـﻞ‬ ‫ﺧﺼﻮﺻﻲ ﺃﻭ ﻋﺪﺓ ﺃﻋﻤﺎﻝ؟‬ ‫‪ ‬ﻻ ﺩﺧﻞ ﻟﻠﻌﻤﻞ ﻓﻲ ﻛﺜﻴﺮ ﺍﻟﺴﻔﺮ ﻓﻬﻤﺎ‬ ‫ﻋﻨﻮﺍﻧﺎﻥ ﻣﻨﻔﺼﻼﻥ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٢١‬ﺍﻟﺼﺎﺋﻢ ﻓﻲ ﺻﺒﺎﺡ ﺷﻬﺮ ﺭﻣﻀﺎﻥ ﻟﻮ‬ ‫ﺧﺮﺝ ﻣﻦ ﻣﻮﻃﻨﻪ ﻭﻗﻄﻊ ﺍﻟﻤﺴﺎﻓﺔ ﻭﻛـﺎﻥ ﻗﺎﺻـﺪﹰﺍ‪ ،‬ﻭﻟﻜﻨـﻪ‬ ‫ﺭﺟﻊ ﻋﻦ ﺳﻔﺮﻩ ﻟﻌﺬﺭ ﻭﺩﺧﻞ ﺇﻟﻰ ﻣﻮﻃﻨﻪ ﻗﺒﻞ ﺍﻟﺰﻭﺍﻝ‪ ،‬ﻣﺎ‬ ‫ﻫﻮ ﺣﻜﻤﻪ ﺗﺠﺎﻩ ﺍﻟﺼﻮﻡ ﻓﻲ ﻫﺬﺍ ﺍﻟﻴﻮﻡ؟‬ ‫‪ ‬ﻭﺟﺐ ﻋﻠﻴـﻪ ﺍﻟﺼـﻮﻡ ﺣﺴـﺐ ﻓـﺮﺽ‬ ‫ﺍﻟﺴﺆﺍﻝ‪ ،‬ﻣﺎ ﻟﻢ ﻳﺘﻨﺎﻭﻝ ﺍﻟﻤﻔﻄﺮ ﻓﻴﺠﺪﺩ ﺍﻟﻨﻴﺔ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٢٢‬ﻧﺤﻦ ﻧﻌﻠﻢ ﺃﻥ ﺍﻟﺴﻴﺪ ﺍﻟﺸـﻬﻴﺪ‪‬‬ ‫ﻳﻘﻮﻝ ﺃﻥ ﻣﺎ ﺑﻴﻦ ﺍﻟﺘﻤﺎﻣﻴﻦ ﺗﻤﺎﻡ ﺑﺎﻟﻨﺴـﺒﺔ ﻟﺤﻜـﻢ ﺍﻟﺼـﻼﺓ‪،‬‬

‫ﻓﻲ ﺿﻴﺎﻓﺔ ﺍﷲ‬ ‫)‪(٣١٨‬‬ ‫ﺳﻴﺪﻧﺎ ﻫﻞ ﻳﺠـﻮﺯ ﻟﻠﺼـﺎﺋﻢ ﻓـﻲ ﺻـﺒﺎﺡ ﻧﻬـﺎﺭ ﺍﻟﺼـﻮﻡ ﺃﻥ‬ ‫ﻳﺴﺎﻓﺮ ﻣﻦ ﻣﻮﻃﻨﻪ ﺇﻟﻰ ﻣﺤﻞ ﻋﻤﻠـﻪ ﻭﻣـﺎ ﺣﻜـﻢ ﻧﻴﺘـﻪ ﻓـﻲ‬ ‫ﺍﻟﻄﺮﻳﻖ؟‬ ‫‪ ‬ﻣﻨﻬﺞ ﺍﻟﺼﺎﻟﺤﻴﻦ ﺝ‪ ٢‬ﺹ‪) ٣٥‬ﻣﺴﺄﻟﺔ‬ ‫‪ :(٧٤‬ﻳﺼ ‪‬ﺢ ﺍﻟﺼـﻮﻡ ﻣـﻦ ﺍﻟﻤﺴـﺎﻓﺮ ﺍﻟـﺬﻱ ﺣﻜﻤـﻪ ﺍﻟﺘﻤـﺎﻡ‬ ‫ﻭﺍﺟﺒﺎﹰ ﻛﺎﻥ ﺍﻟﺼﻮﻡ ﺃﻡ ﻣﺴﺘﺤﺒﹰﺎ ﻛﻨﺎﻭﻱ ﺍﻹﻗﺎﻣﺔ ﻭﺍﻟﻤﺴـﺎﻓﺮ‬ ‫ﺳﻔﺮ ﻣﻌﺼﻴﺔ ﻭﺍﻟﺬﻱ ﻋﻤﻠﻪ ﺍﻟﺴﻔﺮ ﻭﻋﻤﻠﻪ ﻓﻲ ﺍﻟﺴﻔﺮ ﻭﻏﻴﺮ‬ ‫ﺫﻟﻚ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٢٣‬ﺇﺫﺍ ﺫﻫﺐ ﺷﺨﺺ ﺇﻟﻰ ﺑﻐـﺪﺍﺩ ﻓـﻲ‬ ‫ﺷﻬﺮ ﺭﻣﻀﺎﻥ ﻭﻧﻮﻯ ﺍﻹﻗﺎﻣﺔ ﻓﻲ ﻣﻨﻄﻘﺔ ﺷـﻌﻠﺔ ﺍﻟﺼـﺪﺭﻳﻦ‬ ‫ﻟﻌﺸــﺮﺓ ﺃﻳــﺎﻡ‪ ،‬ﻓﻬــﻞ ﻟــﻪ ﺍﻟــﺬﻫﺎﺏ ﻟﻠﻤﺒﻴــﺖ ﺃﻭ ﻟــﺒﻌﺾ‬ ‫ﺍﻟﺴﺎﻋﺎﺕ؟ ﻭﻫﻞ ﺻﺤﻴﺢ ﻣﻦ ﻭﺟـﻮﺩ ﻭﻗـﺖ ﻣﺤـﺪﺩ )ﺃﻱ‬ ‫ﺳﺘﺔ ﺳﺎﻋﺎﺕ( ﺇﻟﻰ‪:‬‬ ‫‪ -١‬ﺍﻟﻜﺎﻇﻤﻴﺔ‪.‬‬

‫ﺍﻟﺴﻴﺪ ﻣﻘﺘﺪﻯ ﻣﺤﻤﺪ ﺍﻟﺼﺪﺭ )‪(٣١٩‬‬ ‫‪ -٢‬ﺍﻟﺤﺮﻳﺔ‪.‬‬ ‫‪ -٣‬ﻣﺪﻳﻨﺔ ﺍﻟﺼﺪﺭ‪.‬‬ ‫ﺃﻡ ﻳﻌﺘﺒـــﺮ ﻣﻔﻄـــﺮﹰﺍ؟ ﻋﻠﻤـــﺎﹰ ﺃﻥ ﺍﻟﺴـــﻴﺪ ﺍﻟﺸـــﻬﻴﺪ‬ ‫ﺍﻟﺼﺪﺭ‪ ‬ﻳﻘﻮﻝ ﻓـﻲ ﺍﻟﻤـﻨﻬﺞ‪ :‬ﺇﻥ ﺑﻐـﺪﺍﺩ ﻭﺍﻟﻜﺎﻇﻤﻴـﺔ‬ ‫ﺍﻟﻤﻘ ‪‬ﺪﺳﺔ ﻣﺪﻳﻨﺘﻴﻦ ﻭﻗﺪ ﻭﺟﺪﺕ ﻋﺪﺩﹰﺍ ﻣـﻦ ﻃﻠﺒـﺔ ﺍﻟﺴـﻴﺪ‬ ‫ﺍﻟﺼﺪﺭ‪ ‬ﻳﻘﻮﻝ ﺇﻥ ﻫﺬﺍ ﺍﻟﺮﺃﻱ ﻗﺪﻳﻢ ﻭﺑﻐﺪﺍﺩ ﺍﻵﻥ ﻗﺪ‬ ‫ﺍﺗﺼﻠﺖ ﻭﺃﺻﺒﺤﺖ ﻣﺪﻳﻨﺔ ﻭﺍﺣﺪﺓ‪ ،‬ﻷﻧﻬﺎ ﻣﺘﺼـﻠﺔ ﺍﻷﺑﻨﻴـﺔ‬ ‫ﺑﻴﻦ ﺍﻟﻜﺮﺥ ﻭﺍﻟﺮﺻﺎﻓﺔ ﻭﺣﺘﻰ ﺍﻟﻜﺎﻇﻤﻴـﺔ ﺍﻟﻤﻘ ‪‬ﺪﺳـﺔ‪ ،‬ﻓﻤـﺎ‬ ‫ﺗﻘﻮﻝ؟‬ ‫‪ ‬ﻧﻌﻢ ﺍﻹﻗﺎﻣﺔ ﻓﻲ ﻣﻜﺎﻥ ﻳﺴﺘﺪﻋﻲ ﻋﺪﻡ‬ ‫ﺍﻟﻤﻜﺚ ﻓﻲ ﺧﺎﺭﺟﻪ ﻃﻮﻳﻼﹰ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٢٤‬ﺳﻜﻨﻲ ﻓﻲ ﺍﻟﻨﺠـﻒ ﻭﺃﺳـﺎﻓﺮ ﺇﻟـﻰ‬ ‫ﺍﻟﻤﺸﺨﺎﺏ ﻓﻲ ﺍﻷﺳﺒﻮﻉ ﺛﻼﺙ ﻣﺮﺍﺕ ﻫﻞ ﺃﺻﺒﺤﺖ ﻛﺜﻴﺮ‬ ‫ﺍﻟﺴﻔﺮ؟ ﻓﺎﺻﻠﻲ ﺗﻤﺎﻣﺎﹰ ﻭﺃﺻﻮﻡ؟‬

‫ﻓﻲ ﺿﻴﺎﻓﺔ ﺍﷲ‬ ‫)‪(٣٢٢‬‬ ‫ﺑﻴﺘﻲ ﺗﺘﺠﺎﻭﺯ ﺍﻟﻤﺴﺎﻓﺔ ﺍﻟﺸـﺮﻋﻴﺔ ﻟﻺﻓﻄـﺎﺭ ﻭﺇﺫﺍ ﺃﺑﻘـﻰ ﻓـﻲ‬ ‫ﺍﻟﻌﻤﻞ ﻟﻤﺪﺓ ﺧﻤﺴﺔ ﺃﻳﺎﻡ ﻭﺃﺭﺟـﻊ ﺇﻟـﻰ ﺍﻟﺒﻴـﺖ ﺍﻟﺨﻤـﻴﺲ‬ ‫ﻭﺍﻟ ‪‬ﺠﻤﻌﺔ ﻓﻘﻂ‪ .‬ﻓﻬﻞ ﺃﺳﺘﻄﻴﻊ ﺍﻟﺒﻘـﺎﺀ ﻋﻠـﻰ ﺻـﻴﺎﻣﻲ‪ ،‬ﻭﻣـﺎ‬ ‫ﻫﻮ ﺍﻟﻤﻄﻠﻮﺏ ﻣﻨﻲ ﻓﻌﻠﻪ ﻓﻲ ﻫﺬﻩ ﺍﻟﺤﺎﻟﺔ؟‬ ‫‪ ‬ﻧﻌﻢ ﺻﹸﻢ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٢٩‬ﻫﻞ ﻳﺠﻮﺯ ﺍﻟﺼـﻮﻡ ﺃﺛﻨـﺎﺀ ﺗﻮﺍﺟـﺪﻧﺎ‬ ‫ﻓﻲ ﺳﺎﺣﺎﺕ ﺍﻟﻘﺘﺎﻝ ﻭﻧﺤﻦ ﻓﻲ ﻛﻞ ﻳﻮﻡ ﺃﻭ ﻳﻮﻣﻴﻦ ﻧﻨﺘﻘـﻞ‬ ‫ﺇﻟﻰ ﻣﻨﻄﻘﺔ ﺃﺧﺮﻯ؟‬ ‫‪ ‬ﻣـﻊ ﻋـﺪﻡ ﺗـﻮﻓﺮ ﺷـﺮﻭﻁ ﺍﻟﺼـﻮﻡ‪،‬‬ ‫ﻓﺎﻟﻘﺼﺮ ﻣﺘﻌﻴﻦ ﺃﻋﻨﻲ ﺍﻹﻓﻄﺎﺭ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٣٠‬ﺃﻧﺎ ﻃﺎﻟﺒﺔ ﻣﺎﺟﺴـﺘﻴﺮ ﻭﺑﻌـﺪ ﺍﻻﻧﺘﻬـﺎﺀ‬ ‫ﻣﻦ ﻛﺘﺎﺑﺔ ﺍﻟﺮﺳﺎﻟﺔ ﻳﻔﺘﺮﺽ ﺑﻲ ﺍﻟﺬﻫﺎﺏ ﺇﻟﻰ ﺍﻟﺠﺎﻣﻌﺔ ﻓﻲ‬ ‫ﻛﻞ ﺃﺳﺒﻮﻉ ﻣﺮﺓ ﺃﻭ ﺍﺛﻨﻴﻦ ﻟﻐﺮﺽ ﺇﺟﺮﺍﺀﺍﺕ ﺇﺩﺍﺭﻳﺔ‪ .‬ﻓﻔﻲ‬

‫ﺍﻟﺴﻴﺪ ﻣﻘﺘﺪﻯ ﻣﺤﻤﺪ ﺍﻟﺼﺪﺭ )‪(٣٢٣‬‬ ‫ﺳﻔﺮﻱ ﻫﺬﺍ ﻳﻔﺘﺮﺽ ﺑـﻲ ﺃﻥ ﺃﻓﻄـﺮ ﻭﺃﺻـﻠﻲ ﻗﺼـﺮ ﺃﻡ ﻻ‪،‬‬ ‫ﻛﻮﻧﻲ ﻃﺎﻟﺒﺔ؟‬ ‫‪ ‬ﺇﺗﻤﺎﻡ ﺍﻟﺼﻼﺓ ﻭﺍﻟﺼﻴﺎﻡ‪.‬‬ ‫ﻣﺴـﺄﻟﺔ )‪ :(١٣١‬ﺃﻧـﺎ ﻣـﻦ ﺳـﻜﻨﺔ ﻣﺤﺎﻓﻈـﺔ ﻣﻴﺴـﺎﻥ‬ ‫ﻭﻋﻤﻠﻲ ﻓﻲ ﻣﺤﺎﻓﻈﺔ ﺍﻟﺒﺼﺮﺓ ﻭﻳﻜﻮﻥ ﺩﻭﺍﻣﻲ ﺃﺳﺒﻮﻉ ﻓـﻲ‬ ‫ﺍﻟﺒﺼﺮﺓ ﻭﺃﺳﺒﻮﻉ ﻓﻲ ﻣﺤـﺎﻓﻈﺘﻲ‪ ،‬ﻋﻠﻤـﺎﹰ ﺃﻥ ﻋﻤﻠـﻲ ﻋﻤـﻞ‬ ‫ﺧﺎﺹ‪ .‬ﺳﺆﺍﻟﻲ‪ :‬ﻣﺎ ﺣﻜﻢ ﺍﻟﺼﻴﺎﻡ ﻓﻲ ﺷﻬﺮ ﺭﻣﻀﺎﻥ؟‬ ‫‪ ‬ﺣﻜﻤﻚ ﺍﻟﺼﻴﺎﻡ ﻓﻲ ﻛﻠﻴﻬﻤﺎ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٣٢‬ﺇﻧﻲ ﺃﻋﻤﻞ ﻣﻮﻇﻒ ﺣﻜﻮﻣﻲ ﻓـﻲ‬ ‫ﻣﺪﻳﻨﺔ ﺑﻐﺪﺍﺩ‪ ،‬ﻟﻜﻦ ﺑﻴﻦ ﻓﺘﺮﺓ ﻭﺃﺧـﺮﻯ ﻳـﺘﻢ ﺇﻳﻔﺎﺩﻧـﺎ ﺇﻟـﻰ‬ ‫ﺧـﺎﺭﺝ ﺑﻐـﺪﺍﺩ ﻟﻌـﺪﺓ ﺃﻳـﺎﻡ )ﺃﻗـﻞ ﻣـﻦ ‪ ١٠‬ﺃﻳـﺎﻡ( ﻟﻐـﺮﺽ‬ ‫ﺍﺳﺘﻼﻡ ﺍﻟﻤﺸـﺎﺭﻳﻊ ﺃﻭ ﺍﻟﻘﻴـﺎﻡ ﺑﺎﻟﺘﺼـﻠﻴﺤﺎﺕ ﻭﺍﻟﻜﺸـﻮﻓﺎﺕ‬ ‫ﺍﻟﻼﺯﻣ ـﺔ ﻟﻸﺟﻬ ـﺰﺓ ﺍﻟﻤﻮﺟ ـﻮﺩﺓ ﻫﻨ ـﺎﻙ‪ ،‬ﻭﻟ ـﻮﻻ ﺍﻷﻭﺍﻣ ـﺮ‬ ‫ﺍﻹﺩﺍﺭﻳﺔ ﻟﻤﺎ ﻛﻨﺎ ﻧﺬﻫﺐ‪ ،‬ﻓﻤﺎ ﻫﻮ ﺣﺎﻝ‪:‬‬ ‫‪ -١‬ﺻﻼﺗﻨﺎ‪ ،‬ﻫـﻞ ﻧﺒﻘﻴﻬـﺎ ﺗﺎﻣـﺔ؟ ﻭﻫـﻞ ﺻـﻴﺎﻣﻨﺎ ﺗـﺎﻡ‬

‫ﻓﻲ ﺿﻴﺎﻓﺔ ﺍﷲ‬ ‫)‪(٣٢٤‬‬ ‫ﻟﺸﻬﺮ ﺭﻣﻀﺎﻥ؟ ﻷﻥ ﺍﻟﻨﻴﺔ ﻫﻲ ﻧﻴﺔ ﺍﻟﻌﻤﻞ ﻭﻟﻴﺲ ﻧﻴﺔ ﺍﻟﺴﻔﺮ‬ ‫ﻭﻟـﻮ ﻛـﺎﻥ ﻓﻴﻬـﺎ ﺗﺠـﺎﻭﺯ ﻟﻠﻤﺴـﺎﻓﺔ ﺍﻟﺸـﺮﻋﻴﺔ ﻟﻠﻘﺼـﺮ ﻓـﻲ‬ ‫ﺍﻟﺼـﻼﺓ ﻭﺍﻟﻘﻀـﺎﺀ ﻟﻠﺼـﻮﻡ‪ ،‬ﻋﻠﻤـﺎﹰ ﺃﻥ ﺍﻟﺪﻭﻟـﺔ ﻫـﻲ ﺍﻟﺘـﻲ‬ ‫ﺗﺼـﺮﻑ ﻣﺒـﺎﻟﻎ ﺍﻟﺴـﻔﺮ ﻭﺍﻟﻄﻌـﺎﻡ ﻭﺍﻟﻤﻨـﺎﻡ ﻭﻏﻴﺮﻫـﺎ ﻣ ـﻦ‬ ‫ﺍﻟﻤﺼﺮﻭﻓﺎﺕ‪.‬‬ ‫‪ -٢‬ﻭﻧﻔﺲ ﺍﻟﺴﺆﺍﻝ ﻟﻜـﻦ ﺇﺫﺍ ﻛـﺎﻥ ﺍﻹﻳﻔـﺎﺩ ﺧـﺎﺭﺝ‬ ‫ﺍﻟﻌﺮﺍﻕ‪.‬‬ ‫ﺃﺟﻴﺒﻮﻧﺎ ﻳﺮﺣﻤﻜﻢ ﺍﷲ‪ ،‬ﺣﻴﺚ ﺃﻧﻨﻲ ﺃﻋﺎﻧﻲ ﻣﻦ ﻫـﺬﻩ‬ ‫ﺍﻟﻤﺴـﺎﻟﺔ ﻛـﻮﻧﻲ ﺃﻗـﻴﻢ ﺍﻟﺼـﻼﺓ ﺗﺎﻣـﺔ ﻭﺃﺗـﻢ ﺻـﻮﻡ ﺃﻳـﺎﻡ‬ ‫ﺭﻣﻀﺎﻥ ﺍﺳﺘﻨﺎﺩﺍﹰ ﺇﻟـﻰ ﺍﻟﻨﻴـﺔ ﻛﻮﻧﻬـﺎ ﻧﻴـﺔ ﻋﻤـﻞ ﻭﻟـﻮ ﻟﻤـﺮﺓ‬ ‫ﻭﺍﺣﺪﺓ ﻓﻲ ﺍﻟﻌﻤﺮ‪.‬‬ ‫‪ ‬‬ ‫‪ -١‬ﻛﻠﻴﻬﻤﺎ ﺗﺎﻡ‪...‬‬ ‫‪ -٢‬ﻧﻔﺲ ﺍﻟﺠﻮﺍﺏ‪.‬‬

‫ﻓﻲ ﺿﻴﺎﻓﺔ ﺍﷲ‬ ‫)‪(٣٢٦‬‬ ‫ﻳﺘﻜ ‪‬ﺴﺐ ﺑﻨﻔﺲ ﺍﻟﺴـﻔﺮ‪ ،‬ﻛﺎﻟﻤﻜـﺎﺭﻱ ﻭﺍﻟﺴـﺎﺋﻖ ﻭﺍﻟﻄﻴـﺎﺭ‪.‬‬ ‫ﻓﻤﺘﻰ ﺧﺮﺝ ﻓﻲ ﻋﻤﻠـﻪ ﺃﺗـﻢ ﻭﺻـﺎﻡ‪ ،‬ﻭﻣﺘـﻰ ﺧـﺮﺝ ﻟﻐﻴـﺮ‬ ‫ﻋﻤﻠﻪ ﻗﺼﺮ ﻭﺃﻓﻄﺮ‪.‬‬ ‫ﺍﻷﻣﺮ ﺍﻟﺜﺎﻧﻲ‪ :‬ﺃﻥ ﻳﻜﻮﻥ ﻋﻤﻠﻪ ﻓﻲ ﺍﻟﺴﻔﺮ‪ ،‬ﻳﻌﻨﻲ ﺃﻥ‬ ‫ﻳﻜﻮﻥ ﻋﻤﻠﻪ ﻣﺘﻮﻗﻒ ﻋﻠﻰ ﺍﻟﺴﻔﺮ‪ ،‬ﺑﺤﻴﺚ ﻳﺴﺘﺤﻴﻞ ﻋـﺎﺩﺓ‬ ‫ﻣﻤﺎﺭﺳﺘﻪ ﺑﺪﻭﻥ ﺳﻔﺮ‪ .‬ﻛﻤﻦ ﻳﻌﻤﻞ ﻓﻲ ﻣﺪﻳﻨﺔ ﺃﺧﺮﻯ ﻏﻴﺮ‬ ‫ﺍﻟﻤﺪﻳﻨﺔ ﺍﻟﺘﻲ ﻳﺴﻜﻨﻬﺎ‪ ،‬ﻛﺎﻟﻄﺒﻴـﺐ ﻭﺍﻟﻤﻤـﺮﺽ ﻭﺍﻟﻄﺎﻟـﺐ‬ ‫ﻭﺍﻟﻌﺴﻜﺮﻱ ﻭﺍﻟﻤﻮﻇﻒ ﻭﺃﺿﺮﺍﺑﻬﻢ‪ ،‬ﻓﺈﻧﻬﻢ ﺇﻥ ﺫﻫﺒﻮﺍ ﺇﻟﻰ‬ ‫ﺃﻋﻤـﺎﻟﻬﻢ ﺃﺗﻤـﻮﺍ ﻭﺻـﺎﻣﻮﺍ‪ .‬ﻭﻻ ﻳﻔـﺮﻕ ﻓـﻲ ﺍﻟﻄﺎﻟـﺐ ﺑـﻴﻦ‬ ‫ﻃﺎﻟﺐ ﺍﻟﻌﻠﻢ ﺍﻟـﺪﻳﻨﻲ‪ ،‬ﺃﻭ ﺍﻟﻌﻠـﻢ ﺍﻟـﺪﻧﻴﻮﻱ‪ .‬ﻣﻤـﻦ ﻳﻜـﻮﻥ‬ ‫ﺗﻠﻘﻲ ﺍﻟﻌﻠﻢ ﺩﺧﻴ ﹰﻼ ﻓﻲ ﻣﺴﺘﻘﺒﻠﻪ‪ ،‬ﻭﺗﺘﻮﻗﻒ ﻋﻠﻴﻪ ﺣﻴﺎﺗﻪ‪ .‬ﻻ‬ ‫ﻣﺠﺮﺩ ﺍﻟﺒﺤﺚ ﻋﻦ ﻣﺸﻜﻠﺔ ﺗﺎﺭﻳﺨﻴﺔ ﻣﺜﻼﹰ ﻓﻲ ﺍﻟﻤﺼﺎﺩﺭ‪.‬‬ ‫ﺃﻧﺎ ﻣﻮﻇﻒ ﺣﻜﻮﻣﻲ‪:‬‬ ‫ﺃﻭﻻﹰ‪ :‬ﺃﺳــﺎﻓﺮ ﺑﺘﻜﻠﻴــﻒ ﺣﻜــﻮﻣﻲ )ﺇﻳﻔــﺎﺩ ﻋﻤــﻞ(‬ ‫ﺧﺎﺭﺝ ﺍﻟﻤﺤﺎﻓﻈﺔ ﻳﺼﺎﺩﻑ ﻛﻞ ﺷﻬﺮ ﻣﺮﺓ ﺃﻭ ﻣـﺮﺗﻴﻦ ﻓـﻲ‬

‫ﺍﻟﺴﻴﺪ ﻣﻘﺘﺪﻯ ﻣﺤﻤﺪ ﺍﻟﺼﺪﺭ )‪(٣٢٧‬‬ ‫ﺑﻌﺾ ﺍﻷﺣﻴﺎﻥ؟‬ ‫‪ ‬ﺍﻹﺗﻤﺎﻡ‪ ،‬ﺍﻟﺼﻴﺎﻡ‪.‬‬ ‫ﺛﺎﻧﻴﹰﺎ‪ :‬ﺻﺎﺩﻑ ﺇﻳﻔﺎﺩ ﺧﺎﺭﺝ ﺍﻟﺒﻼﺩ ﺇﻟﻰ ﺭﻭﺳﻴﺎ ﻭﻣﺮ‪‬ﺓ‬ ‫ﺇﻟﻰ ﺗﺮﻛﻴﺎ ﻭﻣ ‪‬ﺮﺓ ﺇﻟﻰ ﺍﻟﻬﻨـﺪ ﺑـﺪﻋﻮﺓ ﻣـﻦ ﺷـﺮﻛﺎﺕ ﺇﻟـﻰ‬ ‫ﺷﺮﻛﺘﻨﺎ ﻟﻼﻃﻼﻉ ﻋﻠﻰ ﻣﺼﺎﻧﻊ‪ .‬ﺣﻴـﺚ ﺇﻧـﻲ ﺃﺗـﻢ ﺍﻟﺼـﻼﺓ‬ ‫ﻭﻓﻲ ﺍﻟﻄﺮﻳﻖ ﺃﺟﻤﻊ ﺑﻴﻦ ﺍﻟﻘﺼﺮ ﻭﺍﻟﺘﻤﺎﻡ ﺣﺴﺐ ﺗﻔﺴﻴﺮ ﻣﺎ‬ ‫ﺟﺎﺀ ﺃﻋﻼﻩ ﺑﺎﻟﻤﺴﺎﻟﺔ‪.(١٢٤٣) :‬‬ ‫ﻛﻴﻒ ﺗﻜﻮﻥ ﺻـﻼﺗﻲ ﻭﺻـﻮﻣﻲ؟ ﺣﻴـﺚ ﺳـﻤﻌﺖ‬ ‫ﺃﻛﺜﺮ ﻣﻦ ﺭﺃﻱ ﻭﻻ ﺳﻴﻤﺎ ﻧﺤﻦ ﻣﻘﺒﻠﻴﻦ ﻋﻠـﻰ ﺷـﻬﺮ ﺍﻟﺨﻴـﺮ‬ ‫ﻭﺍﻟﺒﺮﻛﺔ؟‬ ‫‪ ‬ﺍﻹﺗﻤﺎﻡ‪ ،‬ﻭﺍﻟﺼﻴﺎﻡ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٣٥‬ﺳﻴﺪﻧﺎ ﻣﺎ ﺣﻜﻢ ﺍﻟﺼﻴﺎﻡ ﺃﻭ ﺍﻹﻓﻄﺎﺭ‬ ‫ﻓﻲ ﺍﻟﻄﺮﻳﻖ ﻣﺎ ﺑﻴﻦ ﻣﺤﻞ ﺍﻟﺴـﻜﻦ ﻭﻣﺤـﻞ ﺍﻟﻌﻤـﻞ ﻭﻟﺒﻌـﺪ‬ ‫ﺍﻟﻤﺴﺎﻓﺔ ﺍﻟﺸﺮﻋﻴﺔ ﻋﻠﻤﹰﺎ ﻓﻲ ﻣﺤﻞ ﺍﻟﺴﻜﻦ )‪ (٨‬ﺃﻳـﺎﻡ ﻭﻓـﻲ‬

‫ﻓﻲ ﺿﻴﺎﻓﺔ ﺍﷲ‬ ‫)‪(٣٢٨‬‬ ‫ﻣﺤﻞ ﺍﻟﻌﻤﻞ )‪ (١٤‬ﻳﻮﻡ‪.‬‬ ‫‪ ‬ﻣـﺎ ﺑـﻴﻦ ﺍﻟﺘﻤـﺎﻣﻴﻦ ﺗﻤـﺎﻡ‪ ...‬ﻓـﺎﻟﻄﺮﻳﻖ‬ ‫ﺍﻟﻤﺘﻌﺎﺭﻑ ﺑﻴﻦ ﻣﺤﻞ ﺍﻟﺴﻜﻦ ﻭﻣﺤﻞ ﺍﻟﻌﻤﻞ ﺗﻤﺎﻡ ﺃﻳﻀﺎﹰ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٣٦‬ﺍﻟﻤﺴﺎﻓﺔ ﺑﻴﻦ ﺩﺍﺭﻱ ﻭﻋﺸـﻴﺮﺗﻲ ‪٢٧‬‬ ‫ﻛﻢ ﻭﺃﺫﻫﺐ ﺑﺎﻷﺳﺒﻮﻉ ﻣﺮﺓ ﺗﻘﺮﻳﺒﹰﺎ‪ ،‬ﻓﻬـﻞ ﻳـﺘﻢ ﺍﺣﺘﺴـﺎﺏ‬ ‫ﺍﻟﻤﺴﺎﻓﺔ ﺍﻟﺸﺮﻋﻴﺔ ﻣﻦ ﻧﻘﻄﺔ ﺍﻻﻧﻄﻼﻕ ﺇﻟﻰ ﻧﻘﻄﺔ ﺍﻟﻮﺻﻮﻝ‬ ‫ﻓﻲ ﺍﻟﺤﺎﻟـﺔ ﺃﻋـﻼﻩ ﺃﻡ ﺃﻥ ﺍﻟﻤﺴـﺎﻓﺔ ﺍﻟﺸـﺮﻋﻴﺔ ﺑـﻴﻦ ﺣـﺪﻱ‬ ‫ﺍﻟﺘﺮﺧﺺ؟‬ ‫‪ ‬ﻫـﻞ ﺗﻤﻜـﺚ ﻋﻨـﺪﻫﻢ؟!‪ ...‬ﺃﻡ ﺗﺮﺟـﻊ‬ ‫ﻟﻴﻮﻣﻚ‪ ...‬ﻭﻫﻞ ﻋﻮﺩﻙ ﻗﺒﻞ ﺍﻟﺰﻭﺍﻝ؟‪ ...‬ﺃﻡ ﺑﻌﺪﻩ؟!‪ ...‬ﻭﻫﻞ‬ ‫ﺫﻫﺎﺑﻚ ﻟﺰﻳﺎﺭﺗﻬﻢ؟!‪ ...‬ﺃﻡ ﻟﻌﻤﻞ ﻣﻌﻴﻦ؟!‬ ‫ﻣﺴ ـﺄﻟﺔ )‪ :(١٣٧‬ﻣـﺎ ﺍﻟﻔـﺮﻕ ﺑـﻴﻦ ﺣـﺪ ﺍﻟﺘـﺮﺧﺺ‬ ‫ﻭﺍﻟﻤﺴﺎﻓﺔ ﺍﻟﺸﺮﻋﻴﺔ؟ ﻭﺇﺫﺍ ﻛﺎﻥ ﻫﻨﺎﻟﻚ ﻓـﺮﻕ ﺑﻤـﻦ ﻧﻘﺼـﺮ‬

‫ﺍﻟﺴﻴﺪ ﻣﻘﺘﺪﻯ ﻣﺤﻤﺪ ﺍﻟﺼﺪﺭ )‪(٣٢٩‬‬ ‫ﻭﻧﻔﻄﺮ؟‬ ‫‪ ‬ﺇﺫﺍ ﻧـﻮﻯ ﺍﻟﺴـﻔﺮ ﻟﻠﻤﺴـﺎﻓﺔ ﺍﻟﺸـﺮﻋﻴﺔ‬ ‫ﻭﻫﻲ‪ :‬ﺛﻤﺎﻧﻴﺔ ﻓﺮﺍﺳﺦ ﻓﻼ ﻳﺤﻖ ﻟﻠﻤﺴﺎﻓﺮ ﻗﺼﺮ ﺍﻟﺼـﻼﺓ ﺃﻭ‬ ‫ﺗﻨﺎﻭﻝ ﺍﻟﻤﻔﻄﺮ ﻗﺒﻞ ﺣﺪ ﺍﻟﺘـﺮﺧﺺ ﻭﻫـﻮ‪ :‬ﺍﻟﻤﻜـﺎﻥ ﺍﻟـﺬﻱ‬ ‫ﻳﺨﻔﻰ ﻓﻴﻪ ﺷﺨﺺ ﺍﻟﻤﺴﺎﻓﺮ ﻋﻦ ﺍﻟﻨﺎﻇﺮ ﺍﻟﻮﺍﻗﻒ ﻓﻲ ﺁﺧﺮ‬ ‫ﺑﻴﻮﺕ ﺍﻟﻤﺪﻳﻨﺔ‪ ...‬ﺑﺤﻴﺚ ﻻ ﻳﺴﻤﻊ ﺻﻮﺕ ﺃﺫﺍﻧﻬﺎ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٣٨‬ﺳﺎﻓﺮﺕ ﻣﻦ ﻣﺪﻳﻨﺘﻲ ﺍﻟﺴﻤﺎﻭﺓ ﺇﻟﻰ‬ ‫ﻣﺪﻳﻨﺔ ﺍﻟﻨﺠﻒ ﺍﻷﺷﺮﻑ ﻭﺗﺒﻌﺪ ‪١٥٥‬ﻛـﻢ ﻭﺭﺟﻌـﺖ ﺇﻟـﻰ‬ ‫ﺑﻠﺪﺗﻲ ﻗﺒﻞ ﺍﻟﺰﻭﺍﻝ‪ ،‬ﻫﻞ ﺃﺑﻘﻰ ﻋﻠﻰ ﺍﻟﺼﻴﺎﻡ ﻭﻫﻮ ﻣﺠـﺰﻱ‬ ‫ﺃﻡ ﻣﻄﻠﻮﺏ ﻗﻀﺎﺀ ﻳﻮﻡ؟‬ ‫‪ ‬ﻣـﺎ ﻟـﻢ ﺗﺘﻨـﺎﻭﻝ ﺍﻟﻤﻔﻄـﺮ ﻓﻌﻠﻴـﻚ ﺃﻥ‬ ‫ﺗﺼﻮﻡ ﻳﻮﻣﻚ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٣٩‬ﻓﻲ ﺷﻬﺮ ﺭﻣﻀﺎﻥ ﻟﻮ ﺳﺎﻓﺮ ﺍﻟﺼـﺎﺋﻢ‬

‫ﻓﻲ ﺿﻴﺎﻓﺔ ﺍﷲ‬ ‫)‪(٣٣٠‬‬ ‫ﺑﻌﺪ ﺻﻼﺓ ﺍﻟﻈﻬـﺮ ﻣـﻦ ﺑﻠـﺪﻩ ﺇﻟـﻰ ﺩﻭﻟـﺔ ﺃﺧـﺮﻯ ﺑﻄـﺎﺋﺮﺓ‬ ‫ﺳ ـﺮﻳﻌﺔ ﺟ ـﺪﹰﺍ ﻭﻋﻨ ـﺪﻣﺎ ﻭﺻــﻞ ﻟﺘﻠ ـﻚ ﺍﻟﺪﻭﻟ ـﺔ ﺗﺒــﻴﻦ ﺃﻥ‬ ‫ﺍﻟﻤﻐﺮﺏ ﻗﺪ ﺣﻞ ﻓﻔﻄﺮ ﻭﺭﺟﻊ ﻣﻦ ﺣﻴﻨﻪ ﺇﻟﻰ ﺑﻠﺪﻩ ﻭﻛـﺎﻥ‬ ‫ﺃﺫﺍﻥ ﺍﻟﻤﻐﺮﺏ ﻟﻢ ﻳﺤﻦ ﺑﻌﺪ‪ ،‬ﻓﻤﺎ ﺣﻜﻤﻪ؟‬ ‫‪ ‬ﺍﻷﺣﻮﻁ ﺍﻟﻘﻀﺎﺀ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٤٠‬ﺇﺫﺍ ﻧﻮﻯ ﺍﻟﻤﺴﺎﻓﺮ ﻋﺸﺮﺓ ﺃﻳﺎﻡ ﺇﻗﺎﻣﺔ‬ ‫ﻭﻟﻜﻦ ﺣﺪﺙ ﻟﻪ ﻋـﺎﺭﺽ ﻓـﻲ ﺍﻟﻴـﻮﻡ ﺍﻟﺴـﺎﺩﺱ ﻭﺃﺭﺍﺩ ﺃﻥ‬ ‫ﻳﺮﺟﻊ ﻓﻘﻄﻊ ﻧﻴﺔ ﺇﻗﺎﻣﺘﻪ ﺍﻟﺼﺒﺢ‪ ،‬ﻭﻟﻜﻨﻪ ﺳﻴﻐﺎﺩﺭ ﺍﻟﺒﻠﺪﺓ ﻟﻴﻼﹰ‬ ‫ﻷﻥ ﺍﻟﺴ ـﺎﺋﻖ ﻳﺄﺗﻴ ـﻪ ﻟ ـﻴ ﹰﻼ‪ ،‬ﻓﺎﻟﺼ ـﻼﺓ ﺍﻟﺘ ـﻲ ﻳﺼ ـﻠﻴﻬﺎ ﻗﺒــﻞ‬ ‫ﺧﺮﻭﺟﻪ ﻣﻦ ﻣﺤﻞ ﺃﻗﺎﻣﺘﻪ ﻫﻞ ﻫﻲ ﻣﻘﺼـﻮﺭﺓ ﺃﻭ ﻛﺎﻣﻠـﺔ؟‬ ‫ﺃﻣﺎ ﻣﻘﺼﻮﺭﺓ ﺑﺎﻋﺘﺒﺎﺭﻩ ﻗﻄﻊ ﺇﻗﺎﻣﺘﻪ‪ ،‬ﻓﻴﻜﻮﻥ ﻋﻨﻮﺍﻧﻪ ﻣﺴـﺎﻓﺮ‬ ‫ﺃﻭ ﻳﺴﺘﺼﺤﺐ ﺍﻟﺤﺎﻟﺔ ﺍﻟﺴﺎﺑﻘﺔ ﻓﻴﺒﻘﻰ ﻋﻠـﻰ ﺍﻟﺘﻤـﺎﻡ ﺃﻓﺘﻮﻧـﺎ‬ ‫ﻷﻧﻪ ﻭﻗﻊ ﺇﺷﻜﺎﻝ ﺑﻴﻦ ﺍﻟﻄﻠﺒﺔ؟‬ ‫‪ ‬ﻣــﻨﻬﺞ ﺍﻟﺼــﺎﻟﺤﻴﻦ ﺝ‪) ١‬ﻣﺴــﺄﻟﺔ‬

‫ﺍﻟﺴﻴﺪ ﻣﻘﺘﺪﻯ ﻣﺤﻤﺪ ﺍﻟﺼﺪﺭ )‪(٣٣١‬‬ ‫‪)) :(١٢٨٧‬ﺇﺫﺍ ﻋــﺪﻝ ﺍﻟﻤﻘــﻴﻢ ﻋﺸــﺮﺓ ﺃﻳــﺎﻡ ﻋــﻦ ﻗﺼــﺪ‬ ‫ﺍﻹﻗﺎﻣﺔ‪ ،‬ﻓﺈﻥ ﻛﺎﻥ ﻗﺪ ﺻـﻠﻰ ﻓﺮﻳﻀـﺔ ﺭﺑﺎﻋﻴـﺔ ﺗﺎﻣـﺔ ﺑﻘـﻲ‬ ‫ﻋﻠﻰ ﺍﻹﺗﻤﺎﻡ ﺇﻟﻰ ﺃﻥ ﻳﺴﺎﻓﺮ‪ .‬ﻭﺇﻻ ﺭﺟﻊ ﺇﻟﻰ ﺍﻟﻘﺼﺮ ﺳﻮﺍﺀ‬ ‫ﻟﻢ ﻳﺼﻠﻲ ﺃﺻﻼً ﺃﻭ ﺻﻠﻰ ﺻﻼﺓ ﻏﻴﺮ ﻣﻘﺼﻮﺭﺓ ﻛﺎﻟﺼﺒﺢ‬ ‫ﻭﺍﻟﻤﻐﺮﺏ ﺃﻭ ﻛﺎﻥ ﻓﻲ ﺍﻷﻭﻟﻴﺘﻴﻦ ﻣﻦ ﺍﻟﺮﺑﺎﻋﻴﺔ‪ ،‬ﺑﻞ ﻣـﺎ ﺩﺍﻡ‬ ‫ﻟﻢ ﻳﻨﺘﻬﻲ ﻣﻦ ﺍﻟﺮﺑﺎﻋﻴﺔ ﺍﻷﻭﻟﻰ ﻓﻲ ﺳﻔﺮﻩ‪ .‬ﻭﻛﺬﻟﻚ ﻳﺮﺟﻊ‬ ‫ﺇﻟﻰ ﺍﻟﻘﺼﺮ ﺣﺘﻰ ﻟﻮ ﻓﻌﻞ ﻣﺎ ﻻ ﻳﺠﻮﺯ ﻟﻠﻤﺴﺎﻓﺮ ﻓﻌﻠـﻪ ﻣـﻦ‬ ‫ﺍﻟﺼﻮﻡ ﺍﻟﻮﺍﺟﺐ ﻭﺍﻟﻤﺴﺘﺤﺐ ﻭﺍﻟﻨﻮﺍﻓﻞ ﻭﻧﺤﻮﻫﺎ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٤١‬ﺱ‪ :١‬ﻟﻮ ﺳﺎﻓﺮ ﺍﻟﺼﺎﺋﻢ ﺑﻌﺪ ﺍﻟﺰﻭﺍﻝ‬ ‫ﻓﻲ ﻧﻬﺎﺭ ﺻﻮﻡ ﺷﻬﺮ ﺭﻣﻀﺎﻥ ﻫﻞ ﻳﺠﻮﺯ ﻟﻪ ﺍﻹﻓﻄﺎﺭ؟‬ ‫‪ ‬ﻛﻼ‪ ،‬ﺇﻻ ﻣﻊ ﺍﻹﺿﺮﺍﺭ‪.‬‬ ‫ﺱ‪ :٢‬ﻭﺇﺫﺍ ﻛﺎﻥ ﺍﻟﺴﻔﺮ ﺑﻌﺪ ﺍﻟﺰﻭﺍﻝ ﻓﻲ ﻗﻀﺎﺀ ﺷـﻬﺮ‬ ‫ﺭﻣﻀﺎﻥ؟‬ ‫‪ ‬ﻛﻼ‪ ،‬ﺑﻞ ﻳﺒﻘﻰ ﻋﻠﻰ ﺻﻴﺎﻣﻪ‪.‬‬

‫ﻓﻲ ﺿﻴﺎﻓﺔ ﺍﷲ‬ ‫)‪(٣٣٢‬‬ ‫ﺱ‪ :٣‬ﻭﺇﺫﺍ ﻛـﺎﻥ ﺍﻟﺴـﻔﺮ ﺑﻌـﺪ ﺍﻟـﺰﻭﺍﻝ ﻓـﻲ ﺍﻟﺼـﻮﻡ‬ ‫ﺍﻟﻤﺴﺘﺤﺐ؟‬ ‫‪ ‬ﺍﻟﻤﺴﺘﺤﺐ ﻳﺒﻘﻰ ﻣﺴﺘﺤﺐ‪ .‬ﻭﺇﻥ ﺷﺎﺀ‬ ‫ﺍﺳﺘﻤﺮ ﻭﺇﻥ ﺷﺎﺀ ﺃﻓﻄﺮ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٤٢‬ﺳـﻴﺪﻧﺎ ﺍﻟﺤﺒﻴـﺐ ﺃﻧـﺎ ﻃﺎﻟـﺐ ﺛﺎﻟـﺚ‬ ‫ﻣﺘﻮﺳﻂ ﻭﺻﺎﺩﻓﺖ ﺍﻣﺘﺤﺎﻧـﺎﺕ ﻓـﻲ ﺍﻟﺴـﻨﺔ ﺍﻟﻤﺎﺿـﻴﺔ ﻓـﻲ‬ ‫ﺷـﻬﺮ ﺭﻣﻀـﺎﻥ ﺍﻟﻤﺒـﺎﺭﻙ ﻓﺄﻛﻤﻠـﺖ ﺑﻌﻀـﻬﺎ ﻭﺑﻘـﻲ ﺁﺧـﺮ‬ ‫ﺍﻣﺘﺤﺎﻧﻴﻦ ﻭﻛﺎﻥ ﺻﻌﺒﺎﹰ ﻋﻠﻲ‪ ‬ﺩﺭﺍﺳﺘﻬﻢ ﻭﺃﻧﺎ ﺻـﺎﺋﻢ‪ ،‬ﻷﻧـﻲ‬ ‫ﺃﻓﻘﺪ ﺍﻟﺘﺮﻛﻴﺰ ﻓﻲ ﻗﺮﺍﺀﺗﻲ ﻭﻳﻤﻜﻦ ﺃﻥ ﺃﺭﺳـﺐ ﻓـﺄﻓﻄﺮﺕ‬ ‫ﺁﺧﺮ ﺧﻤﺴﺔ ﺃﻳﺎﻡ ﻣﻦ ﺭﻣﻀﺎﻥ‪ ،‬ﻓﻬﻼ ﻋﺮﻓﺘﻤﻮﻧﺎ ﻣﺎﺫﺍ ﻧﻔﻌﻞ‬ ‫ﻓﻲ ﻫﺬﻩ ﺍﻟﺤﺎﻟﺔ؟‬ ‫‪ ‬ﻓﻠـﻴﻜﻦ ﺇﻓﻄـﺎﺭﻙ ﺑﻄﺮﻳﻘـﺔ ﻣﺸـﺮﻭﻋﺔ‬ ‫ﻛﺎﻟﺴﻔﺮ ﺃﻋﻨﻲ ﻗﺼﺪ ﺍﻟﻤﺴﺎﻓﺔ ﺍﻟﺸﺮﻋﻴﺔ‪.‬‬

‫ﺍﻟﺴﻴﺪ ﻣﻘﺘﺪﻯ ﻣﺤﻤﺪ ﺍﻟﺼﺪﺭ )‪(٣٣٣‬‬ ‫ﻣﺴــﺄﻟﺔ )‪ :(١٤٣‬ﺃﺻـ ﱢﻞ ﺍﻟﺠﻤﻌ ـﺔ ﺧـﺎﺭﺝ ﻣﻨﻄﻘﺘﻨ ـﺎ‬ ‫ﻭﺃﻗﻄﻊ ﻣﺴﺎﻓﺔ ﺣﻮﺍﻟﻲ ‪ ١٣‬ﻛﻴﻠﻮ ﻣﺘﺮ ﻭﺑﻌﺪ ﺍﻟﺼﻼﺓ ﺃﺫﻫﺐ‬ ‫ﺑﻌــﺾ ﺍﻷﺣﻴــﺎﻥ ﺇﻟــﻰ ﺑﻐــﺪﺍﺩ ﺍﻟﺤﺒﻴﺒــﺔ ﻟﻠﻤﺸــﺎﺭﻛﺔ ﻓــﻲ‬ ‫ﺍﻟﺘﻈـﺎﻫﺮﺍﺕ ﺃﻭ ﺯﻳـﺎﺭﺓ ﺳـﻴﺪ ﺍﻟﺸـﻬﺪﺍﺀ‪ ‬ﻓﻬـﻞ ﻋﻠﻴﻬـﺎ‬ ‫ﺍﻓﻄﺎﺭ‪.‬‬ ‫‪ ‬ﺍﺫﺍ ﻛـﺎﻥ ﺗﺤﻘـﻖ ﺍﻟﺴـﻔﺮ ﻗﺒـﻞ ﺍﻟـﺰﻭﺍﻝ‬ ‫ﻓﺎﻹﻓﻄﺎﺭ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٤٤‬ﻓـﻲ ﺣـﺎﻝ ﺍﻹﻳﻔـﺎﺩﺍﺕ ﻟﻠﻤـﻮﻇﻔﻴﻦ‬ ‫ﻋﻨﺪ ﺇﺭﺳﺎﻟﻬﻢ ﻣـﻦ ﻗﺒـﻞ ﺩﻭﺍﺋـﺮﻫﻢ ﺑﺼـﻮﺭﺓ ﺭﺳـﻤﻴﺔ ﺇﻟـﻰ‬ ‫ﺧﺎﺭﺝ ﺍﻟﺒﻠﺪ‪ ،‬ﻻ ﻳ‪‬ﻌﺮﻑ ﻣﻜﺎﻥ ﺍﻹﻗﺎﻣﺔ ﻗﺮﺏ ﻣﻜﺎﻥ ﺍﻟﻌﻤﻞ‬ ‫ﺍﻟﻤﺮﺳﻞ ﺇﻟﻴﻪ ﺃﻡ ﺃﺑﻌﺪ ﻣﻦ ﺍﻟﻤﺴﺎﻓﺔ ﺍﻟﺸﺮﻋﻴﺔ‪ ،‬ﺑﻌﺾ ﺍﻷﻳﺎﻡ‬ ‫ﺗﻜ ـﻮﻥ ﻟﻠﻌﻤ ـﻞ ﻭﺑﻌﻀ ـﻬﺎ ﻟﻠﺴــﻴﺎﺣﺔ‪ .‬ﻣ ـﺎ ﺣﻜ ـﻢ ﺍﻟﺼــﻮﻡ‬ ‫ﻭﺍﻟﺼﻼﺓ‪.‬‬

‫ﻓﻲ ﺿﻴﺎﻓﺔ ﺍﷲ‬ ‫)‪(٣٣٤‬‬ ‫‪‬ﻣﺎ ﺩﻣﺖ ﻓﻲ ﺍﻟﻌﻤـﻞ ﻭﻣﻜﺎﻧـﻪ ﻓﺎﻟﺘﻤـﺎﻡ‬ ‫ﻭﺍﻟﺼﻴﺎﻡ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٤٥‬ﻓﻲ ﺍﻟﺴﻨﺔ ﺍﻟﻤﺎﺿﻴﺔ ﻓﻲ ﺑﺪﺍﻳﺔ ﺷـﻬﺮ‬ ‫ﺭﻣﻀﺎﻥ ﺍﻟﻤﺒﺎﺭﻙ ﺷﺎﻫﺪﺕ ﺑﻌﺾ ﻣﻦ ﺇﺧﻮﺗﻲ ﻭﺃﺻﺪﻗﺎﺋﻲ‬ ‫ﻳﻬﺮﺑﻮﻥ ﺑﻌﺾ ﺍﻷﻳﺎﻡ ﻣﻦ ﺍﻟﺼﻴﺎﻡ ﺑﺤﺠﺔ ﺍﻟﺤﻴﻠﺔ ﺍﻟﺸـﺮﻋﻴﺔ‬ ‫ﻭﻛﺬﺍ ﻳﺬﻫﺒﻮﻥ ﻣﻦ ﻣﺤﺎﻓﻈﺔ ﻣﻴﺴـﺎﻥ ﺇﻟـﻰ ﺃﺣـﺪ ﺍﻷﻗﻀـﻴﺔ‬ ‫ﻭﺍﻟﻨﻮﺍﺣﻲ ﻳﻘﻄﻌﻮﻥ ﻣﺴﺎﻓﺔ ﻟﻴﻨﺎﻟﻮﺍ ﺍﻹﻓﻄﺎﺭ ﻭﻳﺮﺟﻌﻮﻥ ﻗﺒﻞ‬ ‫ﻣﻮﻋﺪ ﺃﺫﺍﻥ ﺍﻟﻈﻬﺮ ﺃﻓﻴﺪﻭﻧﺎ ﺑﺨﺼﻮﺹ ﻫﺬﺍ ﺍﻷﻣﺮ ﺳـﻴﺪﻱ‬ ‫ﺍﻟﺤﺒﻴﺐ؟‬ ‫‪ ‬ﻻ ﺇﺷﻜﺎﻝ ﻓـﻲ ﺫﻟـﻚ‪ ...‬ﻓﻠـﻴﺲ ﻋﻠـﻰ‬ ‫ﺍﻟﻤﺴﺎﻓﺮ ﺻﻮﻡ‪.‬‬ ‫ﻣﺴـﺄﻟﺔ )‪ :(١٤٦‬ﻓـﻲ ﻫـﺬﺍ ﺍﻟﺸـﻬﺮ ﺍﻟﻔﻀـﻴﻞ ﻳﻘـﻮﻡ‬ ‫ﺍﻟﺒﻌﺾ ﺑﻘﻄﻊ ﻣﺴﺎﻓﺔ ﺷﺮﻋﻴﺔ ﺣﺘﻰ ﻳﺘﻤﻜﻦ ﻣـﻦ ﺍﻹﻓﻄـﺎﺭ‪،‬‬

‫ﺍﻟﺴﻴﺪ ﻣﻘﺘﺪﻯ ﻣﺤﻤﺪ ﺍﻟﺼﺪﺭ )‪(٣٣٥‬‬ ‫ﻟﻠﻌﻠﻢ ﺃﻧﻪ ﻟﻴﺲ ﻣﺮﻳﺾ‪ ،‬ﻳﻘﻮﻝ ﺳﺄﻗﻀـﻴﻪ ﻓﻴﻤـﺎ ﺑﻌـﺪ‪ .‬ﻫـﻞ‬ ‫ﻳﺠﻮﺯ ﺫﻟـﻚ ﺣﺴـﺐ ﻓﺘـﻮﻯ ﺍﻟﺴـﻴﺪ ﺍﻟﺸـﻬﻴﺪ ﺭﺿـﻮﺍﻥ ﺍﷲ‬ ‫ﺗﻌﺎﻟﻰ ﻋﻠﻴﻪ؟‬ ‫‪ ‬ﻻ ﺇﺷﻜﺎﻝ ﻓﻲ ﺫﻟﻚ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٤٧‬ﺳﻴﺪﻱ ﺍﻟﻤﻔﺪﻯ ﺇﻧﻲ ﺃﻋﻤﻞ ﺳـﺎﺋﻖ‬ ‫ﺗﻜﺴﻲ ﻭﻓﻲ ﺷﻬﺮ ﺭﻣﻀﺎﻥ ﺍﻟﻤﺒﺎﺭﻙ ﻭﻟﻴﺲ ﻟﻲ ﻋﻠـﻢ ﻓـﻲ‬ ‫ﺃﻱ ﻭﻗﺖ ﺃﺧﺮﺝ ﻟﻠﻌﻤﻞ ﻭﻳﺼـﺎﺩﻑ ﺃﺣﻴﺎﻧـﺎﹰ ﺃﺟـﺮﺓ ﺑﻌﻴـﺪﺍﹰ‬ ‫ﻋﻦ ﻣﺤﺎﻓﻈﺘﻲ ) ﺃﺗﺄﺧﺮ ﻋﻠﻰ ﺃﺫﺍﻥ ﺍﻟﻈﻬﺮ(‪ .‬ﺳـﺆﺍﻟﻲ‪ :‬ﻫـﻞ‬ ‫ﺃﺑﻘﻰ ﻋﻠﻰ ﺻﻴﺎﻣﻲ ﺃﻡ ﺃﻓﻄﺮ؟ ﻋﻠﻤﹰﺎ ﻫﺬﺍ ﺑﺎﺏ ﺭﺯﻗﻲ‪.‬‬ ‫‪ ‬ﺍﺑ ‪‬ﻖ ﻋﻠﻰ ﺻﻴﺎﻣﻚ ﻓﻬﺬﺍ ﻋﻤﻠﻚ‪.‬‬ ‫ﻣﺴـﺄﻟﺔ )‪ :(١٤٨‬ﺃﻧـﺎ ﻣـﻦ ﻣﻘﻠـﺪﻱ ﺍﻟﺴـﻴﺪ ﺍﻟﺸـﻬﻴﺪ‬ ‫ﺍﻟﺼﺪﺭ‪ ،‬ﺇﻧـﻲ ﺣﺎﻟﻴـﺎﹰ ﻃﺎﻟـﺐ ﻣﺎﺟﺴـﺘﻴﺮ ﻓـﻲ ﻣﺮﺣﻠـﺔ‬ ‫ﺍﻟﺒﺤـﺚ ﻓـﻲ ﺟﺎﻣﻌـﺔ ﺍﻟﺒﺼـﺮﺓ‪ ،‬ﻭﺃﺫﻫـﺐ ﻟﻠﺒﺼـﺮﺓ ﺧـﻼﻝ‬

‫ﻓﻲ ﺿﻴﺎﻓﺔ ﺍﷲ‬ ‫)‪(٣٣٦‬‬ ‫ﺍﻟﺸـﻬﺮ ‪ ٤‬ﺃﻭ ‪ ٥‬ﺃﻳـﺎﻡ ﻟﻠـﺪﻛﺘﻮﺭ ﺍﻟﻤﺸـﺮﻑ ﻋﻠـﻰ ﺍﻟﺒﺤـﺚ‬ ‫ﺍﻟﺨـﺎﺹ ﺑـﻲ‪ ،‬ﺣﻴـﺚ ﺇﻧﻨـﻲ ﺃﻗـﻮﻡ ﺑﺎﻟﻜﺘﺎﺑـﺔ ﻓـﻲ ﺍﻟﺒﻴـﺖ‬ ‫ﻭﺃﺫﻫﺐ ﻟﻠﺒﺼﺮﺓ ﻷﺭﻳﻪ ﻣﺎ ﻛﺘﺒﺖ ﻟﻴﺼﺤﺢ ﻟﻲ ﻣـﺎ ﻛﺘﺒﺘـﻪ‪،‬‬ ‫ﻋﻠﻤﺎﹰ ﺇﻧـﻲ ﺃﺳـﻜﻦ ﻓـﻲ ﻣﺤﺎﻓﻈـﺔ ﺍﻟﻨﺎﺻـﺮﻳﺔ ﻧﺎﺣﻴـﺔ ﻗﻠﻌـﺔ‬ ‫ﺳﻜﺮ‪ .‬ﻓﻤﺎ ﻫﻮ ﺣﻜﻢ ﺍﻟﺼﻴﺎﻡ ﻓﻲ ﺍﻷﻳﺎﻡ ﺍﻟﺘﻲ ﺃﺫﻫﺐ ﻓﻴﻬـﺎ‬ ‫ﻟﻠﺒﺼﺮﺓ؟‬ ‫‪ ‬ﺣﺴﺐ ﺍﻟﻈﺎﻫﺮ‪ :‬ﺍﻟﻘﺼﺮ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٤٩‬ﺃﻧﺎ ﻣﻮﻇﻒ ﻓﻲ ﺇﺣـﺪﻯ ﺍﻟﺸـﺮﻛﺎﺕ‬ ‫ﺍﻟﻨﻔﻄﻴﺔ ﺍﻟﺤﻜﻮﻣﻴﺔ ﻓﻲ ﺍﻟﺒﺼﺮﺓ ﺃﻋﻤﻞ ﻓﻲ ﻣﻜﺎﻥ ﻳﺒﻌﺪ ﻋﻦ‬ ‫ﻣﻨﺰﻟﻲ ﻣﺎ ﻳﻘﺎﺭﺏ ‪ ٢٧‬ﻛﻢ ﻭﺩﻭﺍﻣﻲ ﻳﻮﻣﻲ‪ ،‬ﻭﻋﻤﻠﻲ ﻳﻜﻮﻥ‬ ‫ﻓﻲ ﺍﻟﺤﻘﻮﻝ ﺍﻟﻨﻔﻄﻴﺔ ﺍﻟﺘﻲ ﺗﺒﻌﺪ ﻋﻠﻰ ﺃﻗﻞ ﺗﻘﺪﻳﺮ ‪ ٢٤‬ﻛـﻢ‬ ‫ﻣـﻦ ﻣﻮﻗـﻊ ﻋﻤﻠـﻲ‪ ،‬ﻭﻋﻤﻠـﻲ ﻳﺘﻄﻠـﺐ ﺍﻟﺘـﺄﺧﻴﺮ ﺇﻟـﻰ ﺑﻌـﺪ‬ ‫ﺍﻟﺰﻭﺍﻝ‪ .‬ﻓﻬﻞ ﺫﻫﺎﺑﻲ ﺇﻟﻰ ﻫﺬﺍ ﺍﻟﻌﻤـﻞ ﺑـﺎﻟﺤﻘﻮﻝ ﻳﻮﺟـﺐ‬ ‫ﻋﻠﻰ ﺍﻹﻓﻄﺎﺭ ﻭﺍﻟﻘﺼـﺮ ﺑﺎﻟﺼـﻼﺓ؟ ﻋﻠﻤـﹰﺎ ﺑـﺄﻥ ﺫﻫـﺎﺑﻲ ﻗـﺪ‬

‫ﺍﻟﺴﻴﺪ ﻣﻘﺘﺪﻯ ﻣﺤﻤﺪ ﺍﻟﺼﺪﺭ )‪(٣٣٧‬‬ ‫ﻳﻜـﻮﻥ ﻓـﻲ ﺍﻟﺸـﻬﺮ ﻣـﺮﺓ ﻭﺃﺣﻴﺎﻧـﺎﹰ ﻓـﻲ ﺍﻟﺸـﻬﺮ ﺃﻛﺜـﺮ ﻣـﻦ‬ ‫ﺧﻤــﺲ ﻣــﺮﺍﺕ ﻭﺃﺣﻴﺎﻧــﺎﹰ ﻓــﻲ ﺍﻟﺸــﻬﺮﻳﻦ ﻣــﺮﺓ ﺣﺴــﺐ‬ ‫ﻣﺘﻄﻠﺒﺎﺕ ﺍﻟﻌﻤﻞ‪.‬‬ ‫‪ ‬ﺍﺗﻤﺎﻡ ﺑﺎﻟﺼﻼﺓ ‪ ....‬ﻭﺍﻟﺼﻴﺎﻡ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٥٠‬ﻫﻞ ﻳﺠﻮﺯ ﻟﻠﺸﺨﺺ ﺍﻟﺬﻱ ﻟﺪﻳﻪ‬ ‫ﻋﻤﻠﻴـﺔ )ﻣ ـﺮﺍﺭﺓ( ﺃﻥ ﻻ ﻳﺼ ـﻮﻡ ﺭﻣﻀـﺎﻥ ﻟﺘﺄﺛﻴﺮﻫ ـﺎ ﻋﻠ ـﻰ‬ ‫ﺻﺤﺘﻪ‪ ،‬ﻋﻠﻤﺎﹰ ﺍﻟﻌﻤﻠﻴﺔ ﻗﺪ ﻣﻀﻰ ﻋﻠﻴﻬﺎ ﻣﻦ ﺍﻟﻮﻗﺖ )ﺗﺴـﻌﺔ‬ ‫ﺃﺷﻬﺮ(؟‬ ‫‪ ‬ﻫﻮ ﺃﻋﺮﻑ ﺑﺤﺎﻟﻪ ﻭﺍﻟﻀﺮﺭ ﻭﻋﺪﻣﻪ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٥١‬ﺇﻧﻲ ﺃﺣﺪ ﻣﺠﺎﻫﺪﻱ ﺳﺮﺍﻳﺎ ﺍﻟﺴـﻼﻡ‬ ‫ﻓﻲ ﻗﺎﻃﻊ ﺳﺎﻣﺮﺍﺀ ﺍﻟﻤﻘ ‪‬ﺪﺳﺔ ﻭﻳﻜـﻮﻥ ﻧﺰﻭﻟـﻲ ﻛـﻞ ﺳـﺒﻌﺔ‬ ‫ﺃﻳﺎﻡ ﺃﻭ ﻋﺸﺮﺓ ﺃﻳـﺎﻡ‪ ،‬ﻓﻬـﻞ ﺗﻌﺘﺒـﺮ ﻣﺪﻳﻨـﺔ ﺳـﺎﻣﺮﺍﺀ ﻣـﻮﻃﻦ‬ ‫ﺛﺎﻧﻲ ﻟﻲ؟ ﻭﻫـﻞ ﻳﺠـﻮﺯ ﺍﻟﺼـﻴﺎﻡ ﻓـﻲ ﺃﻳـﺎﻡ ﺷـﻬﺮ ﺷـﻌﺒﺎﻥ‬

‫ﻓﻲ ﺿﻴﺎﻓﺔ ﺍﷲ‬ ‫)‪(٣٣٨‬‬ ‫ﻭﺷﻬﺮ ﺭﻣﻀﺎﻥ؟ ﻋﻠﻤﺎ ﺃﻧﻰ ﻏﻴﺮ ﻣﺘﺄﻛﺪ ﻣﻦ ﺑﻘـﺎﺋﻲ ﻋﺸـﺮﺓ‬ ‫ﺃﻳﺎﻡ ﻭﻻ ﺗﺼﺢ ﺍﻹﻗﺎﻣﺔ‪.‬‬ ‫‪ ‬ﻻ ﻣﺠﺎﻝ ﻟﺘﻌـﺪ‪‬ﺩ ﺍﻷﻭﻃـﺎﻥ ﻭﺟﻬـﺎﺩﻙ‬ ‫ﺇﺫﺍ ﻛﺎﻥ ﻓﻌﻠﻴﺎﹰ ﻓﻬﻮ ﻳﻌﺎﺩﻝ ﺍﻟﺼﻴﺎﻡ ﺇﻥ ﺷﺎﺀ ﺍﷲ‪.‬‬ ‫ﻣﺴــﺄﻟﺔ )‪ :(١)(١٥٢‬ﻣﺴــﺄﻟﺔ ﺍﻟﺼــﻼﺓ ﻭﺍﻟﺼــﻴﺎﻡ‪،‬‬ ‫ﺍﻷﻋﻢ ﻳﺨﺘﻠﻒ ﺣـﻮﻝ ﻫـﺬﺍ ﺍﻷﻣـﺮ‪ ،‬ﺍﻟـﺒﻌﺾ ﻳﻘـﻮﻝ ﻧﺤـﻦ‬ ‫ﺻﻼﺗﻨﺎ ﺗﻤﺎﻡ ﻷﻧﻨﺎ ﺛﺎﺑﺘﻴﻦ ﻓﻲ ﻫﺬﺍ ﺍﻟﻤﻜﺎﻥ ﻭﺍﻵﺧـﺮ ﻳﻘـﻮﻝ‬ ‫ﺻﻼﺗﻨﺎ ﻗﺼﺮ ﻷﻧﻨﺎ ﺍﺗﺼﺎﻟﻨﺎ ﺑﻄﻼﺏ ﺣﻮﺯﺓ ﻭﻛﺎﻥ ﺟـﻮﺍﺑﻬﻢ‬ ‫ﺍﻟﺼﻼﺓ ﻗﺼﺮ‪ .‬ﻓﻤﺎ ﻫﻮ ﺍﻟﺤﻜﻢ ﺳﻴﺪﻱ ﺍﻟﻘﺎﺋﺪ؟‬ ‫‪ ‬ﻛ ﹲﻞ ﺣﺴـﺐ ﺗﻜﻠﻴﻔـﻪ ﻭﺗﻘﻠﻴـﺪﻩ ﺇﻻ ﺃﻥ‬ ‫ﻓﺘــﻮﻯ ﺍﻟﺴــﻴﺪ ﺍﻟﻮﺍﻟــﺪ‪ ‬ﻻ ﺗﻌﺘﺒــﺮ ﺍﻟﺠﻬــﺎﺩ ﻋﻤــ ﹰﻼ‪...‬‬ ‫ﻓﺎﻟﻘﺼﺮ‪.‬‬ ‫)‪ (١‬ﺍﻟﺴﺆﺍﻝ ﻣﻮﺟﻪ ﻣﻦ ﻗﺒﻞ ﺟﻨﺪﻱ ﻓﻲ ﺳﻮﺡ ﺍﻟﺠﻬﺎﺩ‪.‬‬

‫ﺍﻟﺴﻴﺪ ﻣﻘﺘﺪﻯ ﻣﺤﻤﺪ ﺍﻟﺼﺪﺭ )‪(٣٣٩‬‬ ‫‪ ‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٥٣‬ﺑﻌﺾ ﺍﻟﻌﻮﺍﺋﻞ ﺗﺠﺒﺮ ﺃﻃﻔﺎﻟﻬﺎ ﻋﻠـﻰ‬ ‫ﺍﻟﺼﻮﻡ ﻓﻲ ﺷﻬﺮ ﺭﻣﻀﺎﻥ ﻣﻦ ﺑﺎﺏ ﺗﻌﻠﻴﻤﻬﻢ ﻋﻠـﻰ ﻋﺒـﺎﺩﺓ‬ ‫ﺍﻟﺼﻮﻡ‪ ،‬ﻫﻞ ﻳﺠﻮﺯ ﺫﻟﻚ ﺃﻭ ﻻ ﻳﺠﻮﺯ‪ ،‬ﻭﻫﻞ ﻫﻨﺎﻙ ﺑـﺪﻳﻞ‬ ‫ﻟﺘﻌﻠﻴﻤﻬﻢ؟‬ ‫‪ ‬ﺍﻟﺘﺮﻏﻴــﺐ ﺃﻭﻟــﻰ ﻣــﻦ ﺍﻟﺘﺮﻫﻴــﺐ‬ ‫ﻓﺎﻟﺘﺮﻫﻴﺐ ﻗﺪ ‪‬ﻳﻨﺘﺞ ﻣﻨﻪ ﻧﻔﻮﺭﻫﻢ ﻻﺣﻘﹰﺎ‪.‬‬ ‫ﻣﺴـﺄﻟﺔ )‪ :(١٥٤‬ﻛﺜﻴـﺮ ﻣـﻦ ﺍﻟﻨـﺎﺱ ﻳﻔﻄـﺮﻭﻥ ﻭﻻ‬ ‫ﻳﺼﻮﻣﻮﻥ ﺑﺤ‪‬ﺠ‪‬ﺔ ﺍﻟﺤـ ‪‬ﺮ ﺍﻟﺸـﺪﻳﺪ ﻭﻫـﺬﺍ ﻣـﺎ ﺃﺷـﺎﻫﺪﻩ ﻓـﻲ‬ ‫ﺍﻟﺸﺎﺭﻉ‪ ،‬ﻫﻞ ﻳﺼﺢ ﺫﻟﻚ؟‬ ‫‪  ‬ﻫﺬﺍ ﺍﻟﻌﺬﺭ ﻓﻲ ﺣﺪ‪ ‬ﺫﺍﺗﻪ ﻏﻴـﺮ ﻛـﺎﻓﻲ‬ ‫ﺃﻛﻴﺪﹰﺍ‪ ،‬ﺇﻻ ﺇﺫﺍ ﺃﺩﻯ ﺍﻟﺤﺮ ﺇﻟﻰ ﻣﺮﺽ ﻣﺎﻧﻊ ﻣﺜ ﹰﻼ ﺃﻭ ﺣـﺮﺝ‬ ‫ﺷﺪﻳﺪ ﻻ ﻳﺪﻓﻊ ﺇﻻ ﺑﺎﻹﻓﻄﺎﺭ‪.‬‬

‫ﻓﻲ ﺿﻴﺎﻓﺔ ﺍﷲ‬ ‫)‪(٣٤٠‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٥٥‬ﻋﻨﺪﻣﺎ ﺗﺤﺪﺙ ﺣﺎﻟـﺔ ﺇﻏﻤـﺎﺀ ﻋﻨـﺪ‬ ‫ﺍﻟﺼـﺎﺋﻢ ﻟﺴـﺒﺐ ﺍﻟﻌﻄـﺶ ﺃﻭ ﺃﺷـﻴﺎﺀ ﺃﺧـﺮﻯ‪ ،‬ﻓﻔـﻲ ﺣﺎﻟـﺔ‬ ‫ﺇﻓﻄﺎﺭﻩ ﻭﺍﺳﺘﻌﺎﺩﺓ ﺣﺎﻟﺘﻪ ﺍﻟﺼﺤﻴﺔ ﻫـﻞ ﻳﻜﻤـﻞ ﺻـﻴﺎﻣﻪ ﺃﻭ‬ ‫ﻳﺒﻘﻰ ﻋﻠﻰ ﺇﻓﻄﺎﺭﻩ؟‬ ‫‪ ‬ﻳﺒﻘﻰ ﻣﻤﺴﻜﹰﺎ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٥٦‬ﺷﺨﺺ ﺍﻟﺼﻮﻡ ﻳﻀـﺮ ﺑـﻪ ﺑﺤﺴـﺐ‬ ‫ﺗﺠﺮﺑﺘﻪ ﻭﻛﺬﻟﻚ ﻧﻬﺎﻩ ﺍﻟﻄﺒﻴﺐ ﻋﻦ ﺍﻟﺼﻴﺎﻡ‪ ،‬ﻭﻟﻜﻨﻪ ﻳﻘـﻮﻝ‬ ‫ﺃﻧﺎ ﻓﻲ ﺃﻭﻝ ﻳﻮﻣﻴﻦ ﺃﺗﻀﺮﺭ ﻭﻟﻜﻦ ﺑﻌـﺪ ﺫﻟـﻚ ﻻ ﺃﺗﻀـﺮﺭ‪،‬‬ ‫ﻓﻬﻞ ﻳﺠﻮﺯ ﻟﻪ ﺍﻟﺼﻴﺎﻡ ﻭﻣﺎ ﺣﻜﻢ ﺍﻟﻴﻮﻣﻴﻦ ﺍﻷﻭﻟﻴﻦ؟‬ ‫‪ ‬ﻫﺬﺍ ﺭﺍﺟﻊ ﻟﻼﻃﻤﺌﻨـﺎﻥ ﻭﺍﻟﺜﻘـﺔ‪ ،‬ﻓـﺈﺫﺍ‬ ‫ﺍﻃﻤﺌﻦ ﻭﻭﺛﻖ ﺑﻘﻮﻟﻬﻢ ﻓﻨﻌﻢ‪ .‬ﻭﺇﻻ ﻓﻴﻌﻤﻞ ﺣﺴﺐ ﻣـﺎ ﻳـﺮﺍﻩ‬ ‫ﻣﻨﺎﺳﺒﹰﺎ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٥٧‬ﻣﺎ ﺣﻜﻢ ﺻﺎﺣﺐ ﺍﻟﺤﺼﻰ ﻭﺍﻟﺮﻣﻞ‬

‫ﺍﻟﺴﻴﺪ ﻣﻘﺘﺪﻯ ﻣﺤﻤﺪ ﺍﻟﺼﺪﺭ )‪(٣٤١‬‬ ‫ﻓﻲ ﺍﻟ ‪‬ﻜﻠﻴﺔ ﻋﻨﺪ ﺍﻟﺼﻮﻡ‪ ،‬ﻫﻞ ﻳﻔﻄﺮ ﺃﻡ ﻳﺼﻮﻡ؟‬ ‫‪ ‬ﻣﻊ ﺍﻟﻀﺮﺭ ﻓﻴﺤﺮﻡ ﺍﻟﺼﻮﻡ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٥٨‬ﺍﻟﺼﺎﺋﻢ ﺇﺫﺍ ﻏﻠﺒﻪ ﺍﻟﺠﻮﻉ ﺃﻭ ﺍﺣﺘﺎﺝ‬ ‫ﺇﻟﻰ ﺩﻭﺍﺀ ﺿﺮﻭﺭﻱ‪ ،‬ﻫﻞ ﻳﻠﺤﻖ ﺑﺤﻜﻢ ﻣﻦ ﻏﻠﺒﻪ ﺍﻟﻌﻄـﺶ‬ ‫ﺃﻡ ﻻ؟‬ ‫‪ ‬ﻗـﺪ ﻳﺤـﺮﻡ ﺍﻟﺼـﻮﻡ ﻓـﻲ ﺑﻌـﺾ ﺗﻠـﻚ‬ ‫ﺍﻟﺤﺎﻻﺕ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٥٩‬ﺃﻧﺎ ﻋﻤﺮﻱ ‪ ٢٠‬ﺳـﻨﺔ ﻭﺃﻋـﻴﺶ ﻓـﻲ‬ ‫ﺍﻟﺴﻮﻳﺪ ﻭﻓﻲ ﺷﻬﺮ ﺭﻣﻀﺎﻥ ﻧﺼﻮﻡ ‪ ٢٣-٢٢‬ﺳﺎﻋﺔ ﺗﻘﺮﻳﺒـﺎﹰ‬ ‫ﻭﻓﻲ ﻫﺬﺍ ﺍﻟﺼﻴﻒ ﺣﺼﻠﺖ ﻋﻠﻰ ﻋﻤﻞ ﻋﻠﻤﹰﺎ ﺃﻥ ﺳـﺎﻋﺎﺕ‬ ‫ﺍﻟﻌﻤﻞ ﻫﻨﺎﻙ ﻫﻲ ‪ ٨ -٩‬ﺳﺎﻋﺎﺕ‪ .‬ﻣﺎﺫﺍ ﺳﻮﻑ ﺃﻓﻌﻞ؟ ﻫﻞ‬ ‫ﺃﺻﻮﻡ ﺃﻡ ﻻ؟‬ ‫‪ ‬ﻧﻌﻢ ﻳﺠﺐ ﺍﻟﺼﻮﻡ ﻣﻊ ﺍﻹﻣﻜﺎﻥ‪.‬‬

‫ﻓﻲ ﺿﻴﺎﻓﺔ ﺍﷲ‬ ‫)‪(٣٤٢‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٦٠‬ﺃﻧﺎ ﻣﻘﻴﻤﺔ ﻓﻲ ﺃﻣﺮﻳﻜﺎ ﻭﺍﺑﻨـﻲ ﻋﻤـﺮﻩ‬ ‫‪ ٢٠‬ﺳﻨﺔ ﻭﻳﻌﻤـﻞ ﻓـﻲ ﺍﻷﻓـﺮﺍﻥ ﻭﻻ ﻳﺴـﺘﻄﻴﻊ ﺍﻟﺼـﻴﺎﻡ ﻣـﻦ‬ ‫ﺷﺪﺓ ﺍﻟﺤﺮ ﻓﻤﺎ ﻫﻮ ﺣﻜﻤﻪ؟ ﻭﻫﻞ ﻳﺠﻮﺯ ﻟـﻲ ﺃﻥ ﺃﻋـﺪ ﻟـﻪ‬ ‫ﺍﻟﻄﻌﺎﻡ ﺃﻡ ﻓﻴﻪ ﺃﻋﺎﻧﺔ ﻋﻠﻰ ﺍﻹﺛﻢ؟‬ ‫‪ ‬ﻧــﺺ ﻣﺴــﺄﻟﺔ )‪ (٧٩‬ﻣــﻦ ﻣــﻨﻬﺞ‬ ‫ﺍﻟﺼﺎﻟﺤﻴﻦ ﺝ‪ ٢‬ﺇﺫﺍ ﺃﻣﻜﻦ ﻟﻠﻌﺎﻣﻞ ﻗﻄﻊ ﺍﻟﻌﻤـﻞ ﺃﻭ ﺗﺒﺪﻳﻠـﻪ‬ ‫ﺧﻼﻝ ﺍﻟﺼﻮﻡ ﻭﺟﺐ ﻓﺈﻥ ﻟﻢ ﻳﻔﻌـﻞ ﻋﻤـﺪﹰﺍ ﻭﺟـﺐ ﻋﻠﻴـﻪ‬ ‫ﺍﻟﺼﻮﻡ ﻓﻲ ﺣﺎﻟﻪ ﺗﻠﻚ ﻣﺎ ﻟﻢ ﻳﻜﻦ ﺿﺮﺭﻩ ﺑﻠﻴﻐﹰﺎ ﻭﺃﺟـﺰﺃﻩ‪...‬‬ ‫ﻭﺇﻥ ﻛﺎﻥ ﺍﻷﺣﻮﻁ ﻣﻌﻪ ﺍﻟﻘﻀﺎﺀ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٦١‬ﺇﻧﻲ ﺷﺎﺏ ﻓﻲ ﺍﻟﺜﻼﺛﻴﻦ ﻣﻦ ﻋﻤﺮﻱ‬ ‫ﺃﻋـﺎﻧﻲ ﻣـﻦ ﻣـﺮﺽ ﺍﻟﺴ ـﻜﺮﻱ ﻭﻗـﺪ ﻧﺼـﺤﻨﻲ ﺍﻟﻄﺒﻴ ـﺐ‬ ‫ﺍﻟﻤﺨﺘﺺ ﺑﻌـﺪﻡ ﺍﻟﺼـﻴﺎﻡ‪ ،‬ﻷﻧـﻪ ﻳﻀـﺮ ﺑﺼـﺤﺘﻲ‪ ،‬ﻭﻟﻜﻨـﻲ‬ ‫ﺃﺣﺲ ﻓﻲ ﺑﻴﻨـﻲ ﻭﺑـﻴﻦ ﻧﻔﺴـﻲ ﺃﻧـﻲ ﺃﺭﺗﻜـﺐ ﺇﺛـﻢ ﺑﻌـﺪﻡ‬

‫ﺍﻟﺴﻴﺪ ﻣﻘﺘﺪﻯ ﻣﺤﻤﺪ ﺍﻟﺼﺪﺭ )‪(٣٤٣‬‬ ‫ﺍﻟﺼﻴﺎﻡ‪ ،‬ﻓﻬﻞ ﺃﻧﺎ ﻣﺄﺛﻮﻡ؟‬ ‫‪ ‬ﻣﻦ ﺧﺎﻑ ﺍﻟﻀـﺮﺭ ﺟـﺎﺯ ﻟـﻪ ﺍﻹﻓﻄـﺎﺭ‬ ‫ﻭﻻ ﺃﺛﻢ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٦٢‬ﺳﻴﺪﻱ ﺃﻧﺎ ﺷـﺨﺺ ﻣﺼـﺎﺏ ﺑـﺪﺍﺀ‬ ‫ﺍﻟﺴﻜﺮﻱ ﻭﻭﺩﺕ ﺃﻥ ﺃﺻـﻮﻡ ﺷـﻬﺮ ﺭﻣﻀـﺎﻥ ﺍﻟﻤﺒـﺎﺭﻙ ﺃﻭ‬ ‫ﺻـﻮﻡ ﻣﺴـﺘﺤﺐ ﻓـﻲ ﻏﻴـﺮ ﺷـﻬﺮ ﺭﻣﻀـﺎﻥ‪ ،‬ﻓﻬـﻞ ﻳﺠـﻮﺯ‬ ‫ﺍﻟﺼﻴﺎﻡ؟ ﻋﻠﻤﹰﺎ ﺃﻥ ﺍﻟﻄﺒﻴﺐ ﻳﻘﻮﻝ ﺃﻧﺖ ﺧﺒﻴﺮ ﺑﻨﻔﺴﻚ‪ ،‬ﻭﺃﻧـﺎ‬ ‫ﻻ ﺃﻋﻠﻢ ﻣﺎ ﻫﻮ ﺍﻟﻀﺮﺭ ﺇﻥ ﺻﻤﺖ‪ ،‬ﻭﺃﺣﻴﺎﻧﺎﹰ ﺃﺷﻌﺮ ﺑﺎﻟﺘﻌـﺐ‬ ‫ﻭﻟﻜﻦ ﺃﺗﺤﻤﻞ‪ ،‬ﻓﻤﺎ ﺣﻜﻢ ﺍﻟﺼﻴﺎﻡ ﻓﻲ ﻫﺬﻩ ﺍﻟﺤﺎﻟﺔ؟‬ ‫‪ ‬ﻧﻌﻢ‪ ،‬ﺃﻧﺖ ﺧﺒﻴﺮ ﻧﻔﺴﻚ‪.‬‬ ‫ﻣﺴــﺄﻟﺔ )‪ :(١٦٣‬ﻗـﺎﻝ ﺗﻌـﺎﻟﻰ‪ÄÃÂ[ :‬‬ ‫‪ ،(١)ZÅ‬ﺳﻴﺪﻱ ﺇﻧﻲ ﻣﺼﺎﺏ ﺑﻤﺮﺽ ﺍﻟﺴﻜﺮﻱ ﻣﻨﺬ‬ ‫)‪ (١‬ﺳﻮﺭﺓ ﺍﻟﺸﻌﺮﺍﺀ‪ ،‬ﺍﻵﻳﺔ‪. ٨٠ :‬‬

‫ﻓﻲ ﺿﻴﺎﻓﺔ ﺍﷲ‬ ‫)‪(٣٤٤‬‬ ‫ﻓﺘﺮﺓ ﻣﻦ ﺍﻟﺰﻣﻦ‪ ،‬ﻓﻲ ﺑﻌﺾ ﺍﻷﺣﻴـﺎﻥ ﺃﺫﻫـﺐ ﺇﻟـﻰ ﺯﻳـﺎﺭﺓ‬ ‫ﺍﻟﻤﻌﺼــﻮﻣﻴﻦ‪ ‬ﻓــﻲ ﺑﻌــﺾ ﺍﻟﺰﻳــﺎﺭﺍﺕ ﺍﻟﻤﺆﻛــﺪﺓ‬ ‫ﺍﻻﺳﺘﺤﺒﺎﺏ ﻣـﻦ ﻗﺒﻴـﻞ ﺯﻳـﺎﺭﺓ ﺍﻟﺸـﻌﺒﺎﻧﻴﺔ‪ ،‬ﻭﻟﻜﻨـﻲ ﺃﺷـﻌﺮ‬ ‫ﺑﺎﻟﻤﺸﻘﺔ ﺍﻟﻌﺎﻟﻴﺔ ﺍﻟﺘﻲ ﺗﺮﻓﻊ ﻣﻦ ﻣﺴﺘﻮﻯ ﺍﻟﺴـﻜﺮ‪ ،‬ﻭﻋﻨـﺪﻣﺎ‬ ‫ﻳﻤﺮ ﻋﻠـﻲ‪ ‬ﺭﻣﻀـﺎﻥ ‪-‬ﻓـﻲ ﺑﻌـﺾ ﺍﻟﺴـﻨﻴﻦ‪ -‬ﺃﺻـﻮﻡ ﻭﻓـﻲ‬ ‫ﺑﻌﻀﻬﺎ ﻻ ﺃﺻﻮﻡ ﻭﻋﻨﺪﻣﺎ ﺃﺻﻮﻡ ﺃﺷـﻌﺮ ﺑﺎﻟﻤﺸـﻘﺔ ﺍﻟﻌﺎﻟﻴـﺔ‪،‬‬ ‫ﻭﻟﻜﻨـﻲ ﺃﺗﺤﻤﻠﻬـﺎ‪ .‬ﺳـﻴﺪﻱ‪ ،‬ﻓﻬـﻞ ﻫـﺬﻩ ﺍﻟﻤﺸـﻘﺔ ﺟـﺎﺋﺰﺓ‬ ‫ﺍﻟﺘﺤﻤﻞ ﺃﻡ ﻻ؟ ﺃﻱ ﻫﻞ ﺯﻳﺎﺭﺗﻲ ﻭﺻﻮﻣﻲ ﺟﺎﺋﺰ ﺃﻡ ﻻ‪.‬‬ ‫‪ ‬ﺇﺫﺍ ﻋ ‪‬ﺪﺕ ﺿﺮﺭﺍﹰ ﻣﻌﺘـﺪ ﻳﺠـﺐ ﻣﻌﻬـﺎ‬ ‫ﺍﻹﻓﻄﺎﺭ ﻭﻛﻞ ﺑﺤﺴﺒﻪ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٦٤‬ﺃﻧﺎ ﻓﻲ ‪ ٢٨‬ﻣﻦ ﺍﻟﻌﻤﺮ ﻣﻀـﻰ ﻋﻠـﻲ‪‬‬ ‫ﺧﻤﺲ ﺳـﻨﻮﺍﺕ ﻟـﻢ ﺃﺻـﻢ ﺷـﻬﺮ ﺭﻣﻀـﺎﻥ ﺑﺴـﺒﺐ ﻋـﺪﻡ‬ ‫ﻗـﺪﺭﺗﻲ ﻋﻠـﻰ ﺍﻟﺼـﻮﻡ ﻟﻌـ ‪‬ﺪﺓ ﺃﺳـﺒﺎﺏ‪ ،‬ﻣﻨﻬـﺎ‪ :‬ﺍﻟﻤـﺮﺽ‪،‬‬ ‫ﻭﻋﻨﺪﻣﺎ ﺃﺣﺎﻭﻝ ﺍﻟﺼﻮﻡ ﺭﻏﻢ ﻋﺪﻡ ﻗﺪﺭﺗﻲ ﻋﻠﻴﻪ ﺃﺻﺒﺤﺖ‬

‫ﺍﻟﺴﻴﺪ ﻣﻘﺘﺪﻯ ﻣﺤﻤﺪ ﺍﻟﺼﺪﺭ )‪(٣٤٥‬‬ ‫ﻃﺮﻳﺤﺔ ﺍﻟﻔﺮﺍﺵ‪ .‬ﺃﻭﺩ ﻣﻦ ﺳﻤﺎﺣﺘﻜﻢ ﺃﻥ ﺃﻋﺮﻑ ﻫـﻞ ﻣـﺎ‬ ‫ﻣﻀﻰ ﻣﻦ ﺷﻬﺮ ﺭﻣﻀﺎﻥ ﺍﻟﺬﻱ ﻟﻢ ﺃﺻﻤﻪ ﺑﻘﻲ ﻓﻲ ﺫﻣﺘﻲ؟‬ ‫ﻭﻛﻴﻒ ﺃﻓﻲ ﺫﻟﻚ ﻭﻣﺎﺫﺍ ﺃﻓﻌﻞ ﺑﻘﺪﻭﻡ ﺷﻬﺮ ﺭﻣﻀـﺎﻥ ﻭﺃﻧـﺎ‬ ‫ﻻ ﺯﻟﺖ ﻻ ﺃﺳﺘﻄﻴﻊ ﺍﻟﺼﻮﻡ ﻣﻊ ﻭﺟﻮﺩ ﺍﻟﻤﺮﺽ ﻭﺍﻟﻈﺮﻭﻑ‬ ‫ﺍﻟﺼﻌﺒﺔ‪ ،‬ﻣﺎ ﻫﻮ ﺭﺩﻛﻢ؟‬ ‫‪ ‬ﺩﻓﻊ ﺍﻟﻔﺪﻳﺔ‪ ...‬ﻭﺍﻟﻘﻀﺎﺀ ﺣﻴﻦ ﻣﻴﺴﺮﺓ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٦٥‬ﻛﺎﻧﺖ ﻭﺍﻟﺪﺗﻲ ﺭﺣﻤﻬﺎ ﺍﷲ ﻣﺮﻳﻀﺔ‬ ‫ﻣﻨﺬ ﻃﻔﻮﻟﺘﻬﺎ‪ ،‬ﻣﺮﻳﻀﺔ ﻭﻣﺮﺿﻬﺎ ﻫﻮ ﺍﻟﺮﺑﻮ ﺍﻟﻌـﺎﻡ ﺍﻟﻤـﺰﻣﻦ‪،‬‬ ‫ﻭﻛﺎﻥ ﻫﺬﺍ ﺍﻟﻤﺮﺽ ﻗﺪ ﻣﻨﻌﻬﺎ ﻣﻦ ﺃﺩﺍﺀ ﺍﻟﺼـﻮﻡ‪ ،‬ﻭﻛﺎﻧـﺖ‬ ‫ﺑﻴﻦ ﻓﺘﺮﺓ ﻭﺃﺧـﺮﻯ ﻳﻘﻌـﺪﻫﺎ ﺍﻟﻤـﺮﺽ ﻓـﻲ ﺍﻟﻔـﺮﺍﺵ ﺃﻳﺎﻣـﹰﺎ‬ ‫ﻓﺘﺘﺮﻙ ﺍﻟﺼﻼﺓ ﺃﺛﻨﺎﺀ ﺍﻟﻤﺮﺽ‪ .‬ﻓﻤﺎ ﺣﻜﻢ ﻛﻞ ﻣﻦ ﺍﻟﺼـﻮﻡ‬ ‫ﻭﺍﻟﺼﻼﺓ‪ ،‬ﻫﻞ ﺃﻗﻀﻲ ﺍﻟﺼﻮﻡ ﻭﺍﻟﺼﻼﺓ ﻣﻌﹰﺎ ﺃﻡ ﺃﺩﻓﻊ ﻓﺪﻳﺔ‬ ‫ﻟﻠﺼﻮﻡ ﻭﺃﻗﻀﻲ ﺍﻟﺼﻼﺓ ﺃﻡ ﻣﺎﺫﺍ؟‬ ‫‪ ‬ﻫﻞ ﻫﻲ ﻣﺘﻮﻓﺎﺓ؟!‪ ..‬ﺇﺫﺍ ﻛﺎﻧﺖ ﻣﺘﻮﻓـﺎﺓ‬

‫ﻓﻲ ﺿﻴﺎﻓﺔ ﺍﷲ‬ ‫)‪(٣٤٦‬‬ ‫ﻭﺃﺭﺩﺕ ﺍﻟﻘﻀ ـﺎﺀ ﻋﻨﻬ ـﺎ ﻓ ـﺄﻗﺾ ﻣــﺎ ﻓﺎﺗﻬ ـﺎ ﻣ ـﻦ ﺍﻟﺼــﻼﺓ‬ ‫ﻭﺍﻟﺼﻮﻡ ﺍﻟﺬﻱ ﻟﻢ ﺗﺼﻤﻪ ﻻ ﻟﻌﺬﺭ ﻭﻟـﻢ ﺗﻘﻀـﻪ ﻣـﻊ ﺯﻭﺍﻝ‬ ‫ﺍﻟﻌﺬﺭ ﻭﺇﻻ ﻓﻼ‪.‬‬ ‫ﻭﺇﻥ ﻟﻢ ﹶﺗ ‪‬ﻚ ﻣﺘﻮﻓﺎﺓ ﻓﻬﻲ ﺍﻟﺘﻲ ﺗﺒﺎﺷﺮ ﻗﻀﺎﺀ ﺍﻟﺼـﻼﺓ‬ ‫ﻭﻳﺴﺘﺤﺐ ﺍﻹﺳـﺮﺍﻉ ﻭﺍﻟﻔﻮﺭﻳـﺔ ﻭﻗـﺪ ﻳﺠـﺐ ﺃﻣـﺎ ﺍﻟﺼـﻮﻡ‬ ‫ﻓﺤﺴﺐ ﺍﻻﺳﺘﻄﺎﻋﺔ ﺃﻭ ﺍﻟﻔﺪﻳﺔ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٦٦‬ﻋﻤﻲ ﻣﺼﺎﺏ ﺑﻤﺮﺽ )ﺟﻠﻄـﺔ ﻓـﻲ‬ ‫ﺍﻟﺪﻣﺎﻍ( ﻭﺇﻥ ﺃﻭﻗﺎﺕ ﺃﺧﺬ ﺍﻟﺪﻭﺍﺀ ﺻﺒﺎﺣﺎﹰ‪ ،‬ﻋﻠﻤﹰﺎ ﺃﻥ ﺃﻛﺜﺮ‬ ‫ﻣﻦ ﺩﻛﺘﻮﺭ ﻣﻨﻊ ﻋﻠﻴﻪ ﺍﻟﺼﻴﺎﻡ ﺑﺤﺠﺔ ﺃﻥ ﺍﻟﺘﻤﻨﻊ ﻋﻦ ﺍﻷﻛﻞ‬ ‫ﻭﺍﻟﺸـﺮﺏ ﻳﻤﻨـﻊ ﻭﺻـﻮﻝ ﺍﻟـﺪﻡ ﻟﻠـﺪﻣﺎﻍ ﻭﻫـﺬﻩ ﻣﺸـﻜﻠﻪ‬ ‫ﻋﺎﺭﺿﻪ‪ .‬ﻫﻮ ﻓﻲ ﺣﻴـﺮﻩ ﻣـﻦ ﺃﻣـﺮﻩ ﻷﻧـﻪ ﻳﺴـﺘﻄﻴﻊ ﺍﻟﺼـﻴﺎﻡ‬ ‫ﻭﺍﻟﺘﺤﻤﻞ ﻭﻟﻜﻦ ﻳﺨﺎﻑ ﻋﻠﻰ ﺗﻔﺎﻗﻢ ﺍﻟﻤﺮﺽ ﻋﻠﻴﻪ‪ .‬ﻣﺎ ﻫﻮ‬ ‫ﺭﺩ ﺳﻤﺎﺣﺘﻜﻢ؟‬ ‫‪ ‬ﺇﺫﺍ ﻛﺎﻥ ﺍﻟﺼﻮﻡ ﻣﻀﺮﹰﺍ ﻓﺎﻹﻓﻄـﺎﺭ ﻫـﻮ‬

‫ﺍﻟﺴﻴﺪ ﻣﻘﺘﺪﻯ ﻣﺤﻤﺪ ﺍﻟﺼﺪﺭ )‪(٣٤٧‬‬ ‫ﺍﻟﻤﺘﻌ‪‬ﻴﻦ‪.‬‬ ‫ﻣﺴــﺄﻟﺔ )‪ :(١٦٧‬ﺇﻧﻨــﻲ ﺃﻣﺘﻠــﻚ ﺍﻟﻜﻠﻴــﺔ ﺍﻟﻮﺍﺣــﺪﺓ‬ ‫ﻭﻧﺼﺤﻨﻲ ﺍﻟﻄﺒﻴـﺐ ﺍﻷﺧﺼـﺎﺋﻲ ﺑﻌـﺪﻡ ﺍﻟﺼـﻮﻡ ﻋﻠﻤـﹰﺎ ﺇﻧـﻪ‬ ‫ﻣﻌﺮﻭﻑ ﺑﺎﻻﻟﺘﺰﺍﻡ ﺍﻟﺪﻳﻨﻲ ﻭﺍﻷﺧﻼﻗﻲ ﻛﻤﺎ ﻓﻲ ﺍﻟﺤﺎﻻﺕ‬ ‫ﺍﻟﺘﺎﻟﻴﺔ‪:‬‬ ‫‪ -١‬ﺭﻓﻀـﺖ ﺍﻹﻓﻄـﺎﺭ ﻭﺻـﻤﺖ ﻋﻠـﻰ ﺍﻟـﺮﻏﻢ ﻣـﻦ‬ ‫ﺍﻟﻤﺮﺽ ﻷﻧـﻪ ﺣﺎﻟﻴـﺎﹰ ﻻ ﻳﺼـﻴﺒﻨﻲ ﺑـﺄﻟﻢ ﻗـﻮﻱ‪ ،‬ﻓﻘـﻂ ﺃﻟـﻢ‬ ‫ﺧﻔﻴﻒ ﻓﻲ ﺑﺪﺍﻳﺔ ﺷﻬﺮ ﺭﻣﻀﺎﻥ؟‬ ‫‪ -٢‬ﺍﻟﻄﺒﻴﺐ ﺃﻋﻄﺎﻧﻲ ﺩﻭﺍﺀ ﻟﺘﺨﻔﻴـﻒ ﺍﻷﺿـﺮﺍﺭ ﻣـﻊ‬ ‫ﺍﻟﺼــﻮﻡ ﻭﺇﻧــﻪ ﻟــﻢ ﻳﻌﻄﻨــﻲ ﺍﻟﻀــﻤﺎﻥ ﺑﻌــﺪﻡ ﺣﺼــﻮﻝ‬ ‫ﻣﻀﺎﻋﻔﺎﺕ ﺻﺤﻴﺔ؟‬ ‫‪ ‬ﺍﻟﺼﻮﻡ ﺍﻟﻀﺮﺭﻱ ﻗﺪ ﻳﻜﻮﻥ ﻣﺤﺮﻣﺎﹰ‪.‬‬

‫ﻓﻲ ﺿﻴﺎﻓﺔ ﺍﷲ‬ ‫)‪(٣٤٨‬‬ ‫‪ ‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٦٨‬ﻓـﻲ ﺍﻟﺼـﻴﻒ ﻳﻜـﻮﻥ ﺍﻟﺼـﻮﻡ ﻓـﻲ‬ ‫ﺍﻟﺴﻮﻳﺪ ﻃﻮﻳﻞ ﺟﺪﺍﹰ ﻣﺎ ﻳﻘـﺎﺭﺏ ﺍﺛﻨـﻴﻦ ﻭﻋﺸـﺮﻳﻦ ﺳـﺎﻋﺔ‪.‬‬ ‫ﻫﻞ ﺻـﺤﻴﺢ ﺃﻥ ﻟﻠﺴـﻴﺪ ﺍﻟﺸـﻬﻴﺪ ﺍﻟﺼـﺪﺭ‪ ‬ﺭﺃﻱ ﻓـﻲ‬ ‫ﺫﻟﻚ؟ ﺃﻱ ﻫﻞ ﻳﺼﺢ‪ ‬ﺍﻟﺼﻮﻡ ﺑﻤﻘﺪﺍﺭ ﺃﻱ ﺑﻠﺪ ﺇﺳﻼﻣﻲ ﺃﻭ‬ ‫ﻣﺎ ﻫﻮ ﺍﻟﻤﺘﻌﺎﺭﻑ ﻋﻠﻴﻪ ﻫﻨﺎﻙ ﻓﻲ ﻧﻬﺎﺭ ﻳﻮﻡ ﺍﻟﺼﻮﻡ؟‬ ‫ﻧﺮﺟﻮ ﺑﻴﺎﻥ ﺭﺃﻱ ﺍﻟﺴﻴﺪ ﺍﻟﺸـﻬﻴﺪ ﺍﻟﺼـﺪﺭ ﻓـﻲ ﺫﻟـﻚ‬ ‫ﺑﺎﻟﺘﻔﺼﻴﻞ‪.‬‬ ‫‪) : ‬ﻣﺴـﺄﻟﺔ ‪ (١٠٥٣‬ﻣـﻦ ﺝ‪ ٢‬ﻣـﻦ ﻣـﻨﻬﺞ‬ ‫ﺍﻟﺼﺎﻟﺤﻴﻦ‪ :‬ﻓﻲ ﺍﻷﻣﺎﻛﻦ ﺍﻟﺘﻲ ﻳﻄﻮﻝ ﻓﻴﻬـﺎ ﺍﻟﻨﻬـﺎﺭ ﻛﺜﻴـﺮﺍﹰ‪،‬‬ ‫ﺑﺤﻴﺚ ﻻ ﻳﺒﻘـﻰ ﻣـﻦ ﺍﻟﻠﻴـﻞ ﺇﻻ ﻗﻠـﻴ ﹰﻼ‪ ،‬ﻛﺮﺑـﻊ ﺃﻭ ﻧﺼـﻒ‬ ‫ﺳــﺎﻋﺔ‪ .‬ﻳﺠــﺐ ﺻــﻮﻡ ﺍﻟﻨﻬــﺎﺭ ﻣــﻊ ﺍﻹﻣﻜــﺎﻥ ﻭﺍﺟﺘﻤــﺎﻉ‬

‫ﺍﻟﺴﻴﺪ ﻣﻘﺘﺪﻯ ﻣﺤﻤﺪ ﺍﻟﺼﺪﺭ )‪(٣٤٩‬‬ ‫ﺍﻟﺸﺮﺍﺋﻂ‪.....‬ﺍﻟﺦ)‪.(١‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٦٩‬ﺃﻋـﻴﺶ ﻓـﻲ ﺑﻠـﺪ ﺍﻟﻨـﺮﻭﺝ‪ ،‬ﻭﻗـﺖ‬ ‫ﺍﻟﺼـﻴﺎﻡ ﻳﺒـﺪﺃ ﻣـﻦ ﺍﻟﺴـﺎﻋﺔ ﺍﻟﺜﺎﻟﺜـﺔ ﺻـﺒﺎﺣﹰﺎ ﺇﻟـﻰ ﺍﻟﺴـﺎﻋﺔ‬ ‫ﺍﻟﺤﺎﺩﻳﺔ ﻋﺸﺮ ﻟﻴ ﹰﻼ‪ ،‬ﺃﻱ ﻣﺎ ﻳﻘﺮﺏ ﻣﻦ ﻋﺸﺮﻳﻦ ﺳﺎﻋﺔ‪ ،‬ﻫﻞ‬ ‫ﻋﻠ ‪‬ﻲ ﺍﻹﻟﺘﺰﺍﻡ ﺑﻬﺬﺍ ﺍﻟﻮﻗﺖ ﺃﻡ ﺃﺗﺒﻊ ﺣﻜﻢ ﺁﺧﺮ؟‬ ‫‪ ‬ﻧﻌﻢ ﺍﻹﻟﺘﺰﺍﻡ ﺑـﻪ ﻣـﻊ ﺍﻹﻣﻜـﺎﻥ‪ ...‬ﻭﺇﻻ‬ ‫ﻓﺎﻟﻘﻀﺎﺀ‪.‬‬ ‫ﻣﺴﺄﻟﺔ )‪ :(١٧٠‬ﺃﻭﺩ ﺍﻻﺳﺘﻔﺴﺎﺭ ﻋﻦ ﺣﻜﻢ ﺍﻟﻤﺘﺸﻴﻊ‬ ‫ﺍﻟﺬﻱ ﻳﻌﻴﺶ ﻓﻲ ﺗﻘﻴﺔ ﻣﻊ ﺃﻫﻠﻪ ﻓﻲ ﺣﺎﻝ ﻋﺪﻡ ﺗﻤﻜﻨﻪ ﻣﻦ‬ ‫ﺍﻹﻓﻄﺎﺭ ﺑﺎﻟﻮﻗﺖ ﺍﻟﺼﺤﻴﺢ ﺣﺴﺐ ﻧﻬﺞ ﺑﻴﺖ ﺍﻟﻨﺒـﻮﺓ‪.‬‬ ‫)‪ ...
